Unlicenced handyman

We hired a handyman to paint and carpet an apartment. We did not agree with the charges of $7,000.00. He is unwilling to negotiate a lower price and has taken the matter to small claims court.

There was not a written contract or a written estimate. Is there a civil code that i could show to the court that states that unlicenced handyman cannot perform services without letting me know what it will cost in advance?

Contracting without a proper license is a misdemeanor under Business & Professions Code � 7028 and is punishable by fines and up to one year in county jail for repeat violations. Section 7031 also prohibits the unlicensed contractor from collecting from you. You can even sue to get back what you paid him.
