My boyfriend had charges on 12/28 19 for possession of buprenorphine and possession of paraphernalia those charges are to be dropped they have everything they need to drop them as far as prescriptions and so on they were supposed to be in court 32520 and have them dismissed by that date but the state's attorney has not dismissed as of yet court is now canceled for that date because of the pandemic for the Coronavirus he's also got charges for a felony burglary on a conveyance as well as another possession of buprenorphine she was founded on both charges re-arrested on 215 of 24 violation of pretrial is there a way for me to put in a motion or somebody to put in a motion for reinstatement pretrial as well as reinstatement of bond due to the fact that the charges from the 28th are to be dropped they just have not been dropped yet because of the pandemic we wanted to get him home as soon as possible those charges are to drop but now his court date is not set until mid-may so he has to wait all the way until then for them cases to be dropped and go to court so that he can reinstate Bond
Your BF's attorney or PD can put in such motions as you suggest. Unless you are a lawyer admitted to practice you cannot. The current suspension of hearings due to Covid 19 has an exception for bond motions. You should direct your observations to his attorney or PD. You could retain a lawyer for him if he does not have onr.
Unless you are a lawyer or a pro se defendant you cannot either "put in a motion to reinstate pretrial terms" or "a motion to reinstate Bond".
Only lawyers and pro se defendant's can file motions. When anyone else "puts in a motion" then that is called "unlawful practice of law" and it is a potential crime.
If you want a Judge to rule on a matter (regarding bond or otherwise) then you need to have a lawyer prepare a legally sufficient motion, electronically file it, serve it on all relevant parties, calendar it for hearing (with sufficient time for all other parties to respond and appear) and then litigate it. That is the legal process.
Wishing your b/f luck and hoping that I have been helpful in answering your question.
Purchase of a home and repairs not completed
My wife and I recently purchased a home, we hired an inspector to look at the home before we closed. Come to find out many of the repairs we requested (both sides signed a repair contract for all the noted discrepancies) were not completed. My question is how long do I have to dispute these repairs and what can I do to get the seller to pay for them.
