Can I file for unemployment (due to COIVID 19) in my current status?
I have somewhat of a unique scenario that I'll try and keep simple and I really appreciate any help and feedback regarding my situation.
I was on an E2 Dependent visa since 2015. My divorce came through 01/21/20 and my visa expired on 05/06/20. As of today I am married to my new partner who is a Canadian Green Card holder. he applied for his citizenship in March and had his biometrics appointment scheduled but that got postponed due to the pandemic.
I'm am looking for a attorney to file my petition to stay here asap.
I am a independent contractor and all of my work stopped after Covid-19. I did receive my stimulus and I have been strongly advised by my ex husbands attorney to apply for unemployment, however I'm a little nervous about this. Would this affected my ability to get a Green Card? Does having a valid I94 and filing an I-130 mean I can apply for unemployment? I have never filed for unemployment before.

Unemployment insurance requires one to be employment eligible. Without EAD one is not.
I live in NJ but worked during the holiday season for a company based in CA. My last paycheck was to be mailed to my home address. I never received that paycheck. I contacted someone from the Payroll Department of the company and they were able to tell me that the check was cashed but was only able provide a little information. However, it was enough for me to suspect that a family member fraudulently cashed the check. I asked the payroll person to provide written documentation and have not received anything. That was 3 weeks ago and since then I have been leaving voicemail messages for this person. She has not returned my calls, emailed me, or contacted me in anyway. I am faced with the possibility of accusing an immediate family member of mail fraud and felony theft. Before I do that, I want to have sufficient proof, which I need the company to provide.
Here is my question - if the company does not respond to my request and does not cooperate, does that constitute hinderance or obstruction?
