Usually the homeowner's association is a part of the covenants and you do not have to sign any type of agreement. This is the kind I am most familiar with and there are times in which the owner has failed to pay dues and at closing it comes to light these are owed. Then the dues come out of any proceeds which go to the seller. If it does not come up until after the closing, then you may be stuck with the cost and that may be an issue for the title company to have to respond as they are supposed to give you a clean title.
