Signed contract a year ago for my wedding that was to be held on 4/17/2020. Due to the coronavirus, the venue can not operate and render services. They issued out a press release on their new terms since they are unable to perform based on the original contract. The dates available to reschedule do not line up with our availability at all. There is a force majore in the original contract. I Would like someone to review original contract and statement release recently sent.
Our firm published a blog article on Fore Majeure clauses and COVID-19. We are representing a number of consumers currently who are in a similar situation.
You may find our Fore Majeure clauses and COVID-19 here https://thriftlegal.com/covid-19-and-force-majeure-clauses/.
We wish you the best and please stay safe.
"There is a force majore in the original contract" - you did not tell us exactly what it says as a remedy but, as stated by the others, the entire document is going to be important. Presumably, it is for a meaningful amount of money. One well known venue in Atlanta recently closed and left several couples hanging (and the owner filed for Bankruptcy) so hopefully it is not the same one. You can google the name if you are not sure.
I agree that you should contact an attorney, preferably one specializing in business and contract law. While some firms bill hourly for the services you desire, other firms, like mine, will quote a fixed fee for review of your contract and press release, and providing you a legal opinion.
You need to contact an attorney directly to review this contract. Most attorneys, as this office does, will review it on an hourly rate basis, without coming into the office.
