If Mr. David copied anything from Ms. Hettinger's expired patent, then things are working as they should. The whole point of a patent is that the inventor tells the world about the invention, in exchange for the right to keep others from copying the same invention for a limited time.
Plagiarism doesn't apply to patents, but you can infringe a patent. However, to infringe a patent, the patent must be valid and not expired. If Ms. Hettinger's patent expired, she has no right to the invention over Mr. David. As to why he did what he did, thats probably a better question for Mr. David.
