I have been purchasing a home for almost 12 years now and only owe roughly $7500 left from a $50,000 agreement. I just found out today that the title is not in the persons name I have been dealing with. He only has a warranty deed and a deed of trust. The catch is the person who has the title has passed away (several years ago I was told). What are my legal rights with the house and or getting my money back?

There isn't enough information here to answer your question. Your right to assert title and/or get your money back are going to be very much determined by the documents. You should consult directly with a civil or real estate practice attorney in your area. Take all of the relevant documents with you.
