Can I file without I-94?

Thee is no need for I-94, even though you can obtain it easily. The stamp on passport is enough. Apply for your adjustment and file all the required evidence as stated on the USCIS website

You can file Form I-102 for a replacement I-94 card.

No, don't worry - your CBP entry/admission stamp on your passport is enough. No need to I-94. There was also no need to "file a FOIA" to obtain a copy of your I-94...
