I was recently playing a game of slow-pitch softball in an adult league. I threw the ball to the second baseman, who missed it. The ball hit the runner in the temple, causing a concussion. She was taken to the hospital by ambulance. I'm TERRIFIED that she will try to sue me for the charges. CAN she sue me? I was under the impression that each player assumes the inherent risk involved when voluntarily participating (??) BTW, I'm in Illinois.
Sorry, but yes, she can sue you. Whether the lawsuit will be successful is another question. Most organized leagues require participants to sign waivers. You might want to take a look a the one your organization uses.
