He can expect that the state attorney William make a plea offer, it will be his choice to accept the offer, make a counteroffer, or keep his not guilty plea and go to trial.

If he is charged with simple possession, it’s a 3rd degree felony which carries a maximum penalty of 5 years in state prison.

There should be discovery and depositions being taken (on hold right now due to the Coronavirus outbreak).

The Public Defender is an attorney assigned by the Court to represent him in his case The Public Defenders are overworked, underpaid, and have multiple clients that overwhelm the criminal justice system. You or your boyfriend can hire a private attorney if you wish to do so. Alternatively, if you want to see the Public Defender, you need to call the office of the PD, schedule an appointment, or go to the PD office and be politely persistent, and respectfully request to meet the PD. The PD does not have to meet with you. You are not the client and the PD owes no duty to you. The current problem with the CoronaVirus has created a serious backup of cases in criminal and civil court. The Florida Supreme Court has ordered there will be no jury trials and no grand juries until further order of the court. The administrative Judges in each of the 20 Circuits have drafted orders that have approved phone and video appearances to occur. No major gatherings of people in court will occur until the CaronaVirus issues are resolved. Percocet is a controlled substance and you need a prescription to lawfully possess it. Simple possession could be a Third Degree Felony punishable by up to 5 years in prison, a $5,000.00 fine or both. Based on what you have said in the facts you presented, The Prosecutor will look at the files and sworn statements and will decide what charges, if any, to file. If you are allowed to have phone calls from your boyfriend in the jail or video visits in the jail, you need to NOT discuss the facts or circumstances of his arrest because all phone calls and jail visits are usually recorded by the jail officers.
