He had emergency surgery in Brazil and the day he was released 3/17 they closed the Embassy due to Covid19. Im here alone and we both desperately want him here (we were planning on starting the greencard process although this isn’t our concern at this moment). His visa is valid until September but as a Brazilian he needs to restamp his passport at the embassy in Brazil. We are desperate, any cutting corners to this?
Unfortunately, you are in the same situation as everyone else whose lives and plans have been affected by consular closings. If he needs a visa stamp, he will need to wait until the consulate reopens to receive it. Only a consulate can issue the stamp. One thing you can do while you are waiting for the consulates to reopen is to start work on your husband's I-140 petition. It can even be filed, indicating that you will consular process in the future, before the consulates reopen. This is because the I-140 is adjudicated by USCIS, and the service centers, for now, are still open. I would recommend working with an attorney with significant experience in extraordinary ability to do this. This is particularly important in light of the current statistics for EB-1A approval. Prior to this administration, the approval rate was over 80%. It is now around 50%. Based on the same statistics, if you receive a Request for Evidence on the case, there is a 2/3 chance that you will ultimately be denied. Take proactive steps to protect your future by getting the right kind of counsel on your side.
If his visa has expired he needs to obtain a new visa. Recommend you contact an immigration attorney to determine your best options for proceeding.
