My car was totalled. My auto/gap insurance paid some. Can I sue the man for the remaining balance?

Yes, you may make a claim against the at-fault driver. If he carried insurance, you would start with a claim to his insurance company. If he did not, you would need to sue him, and if it's for $8K or less, you can do it in small claims court without an attorney. Whether you can collect after obtaining a judgment is another question.

Depends upon why the insurance company didn't pay off your loan total.
