My apartment had caught on fire because of a pot left on the stove . The fire chief advised that per Altamonte springs building code there needs to be a working smoke alarm which there was not . Can take the complex to court for not fowling building and NFPA code.

The question is what damages did you sustain due to the failure to have the smoke alarm v. what damages you would have had anyway due to the fire. Their negligence did not cause the fire only the additional damages, if you can determine the difference you may have a claim for their failure to meet up to their duty to have the smoke alarm. They are not responsible for all damages, however, whoever left the pot on the stove would be responsible.
