I am representing myself against the defendant in a civil lawsuit in the superior court.

To try my best to resolve my lawsuit against the defendant, how do I write a 998 letter/offer to the defendant's attorney?

Is there any forms for 998?

What are the disadvantages of writing a 998 letter?

Sueing a guest

The guest, the owner, and the HOA are refusing any responsibility to fix my unit. The insurance companies of the owner upstairs and the insurance of the HOA have denied my claims saying that the guest caused the incident and all the damages and not their clients! I did not buy additional insurance for inside of my unit. The damages are estimated to be at least around thirty five thousand dollars.

I have contacted a couple of attorneys to retain them, but they will not take my case on contingency basis. I can not afford to pay the fees they are asking. If I represent myself by filing a law suit against the parties for negligence in the superior court, I have the following questions:

1) Besides the guest, the owner and the HOA, who else is legally responsible to me for all my damages?

2) Do the elements of negligence such as) Duty to care,) Breach of that duty,

and) Causation apply to all the three parties?

How can I protect myself from being sued along with the woman who I thougt was my wife for 8 years (she actually knew we were not married) and have used me for her business and personal benefit by not being truthful to me in her transactions. I recently found out that my married is null and void because my supposedly wife did not get a final judgement to the dissolution of her previous marriage and she knew about it, too. Everything I did for her was done based on truth which I later found were a lbunch of lies.

I would like to know what an agency's responsibility is once they have received the petition. Can an agency simply ignore a petition, or do they have to address the specific concerns?

The Plaintiff has filed a lawsuit in the superior court against four defendants and served the summons and the complaint by first class mail. I am one of the defendants.

Based on CA Code of Civil Procedure, didn�t the Plaintiff have to serve the summons and the complaint on the defendants by personal service v. by mail?

If so, can I raise this issue with the court?

I am having a differcult career in the Navy. At this point in my career I would just like to be discharged. I have completed SEAL training and was proud to serve my country as one until they removed me from the community. I extended to do this job and now I am being forced to do a job that I hate.
