The Issue The issue for determination is whether Petitioner's application for licensure as a community association manager by examination should be approved.

Findings Of Fact By application dated January 3, 1998, Jerry George Sardone, Jr. (Petitioner), made application for licensure as a community association manager by examination. Petitioner's application was received by the Department of Business and Professional Regulation, Community Association Managers (Respondent), on or about January 15, 1998. A section entitled "ESSENTIAL INFORMATION FOR APPLICANTS" was located on the first page of the application. The section provided, among other things, the following: Pursuant to Rule 61B-55.004(5)(a)5.[sic], Florida Administrative Code, failing to provide full and complete disclosure or failing to provide accurate information on this application for licensure or in materials subsequently provided to the Division [Division of Professions] will result in the denial of this application. Question numbered 17 of the application inquired, among other things, about Petitioner's criminal background. Question numbered 17 stated in pertinent part: C) Criminal * * * 2. Have you ever been convicted or been found guilty of a felony or misdemeanor, entered a plea of guilty or nolo contendere (no contest) to a felony or misdemeanor? Yes ( ) No ( ) This question applies to any violation of the laws of any state, territory or country without regard to whether the matter is under appeal or you were placed on probation, had adjudication withheld, were paroled or pardoned. Petitioner checked "no" to the above inquiry. If an applicant checked "yes" to the above inquiry, the applicant was required to respond to additional inquiries regarding the applicant's criminal background. One of the additional inquiries involved the outcome of the criminal situation, and one of the possible outcomes listed was "Charges Dismissed (Nol Pros entered)." By letter dated March 5, 1998, Respondent notified Petitioner that, among other things, his application was deficient. The deficiency indicated was that the criminal history received from the Florida Department of Law Enforcement and the Federal Bureau of Investigation indicated that Petitioner had a criminal history that he had not revealed on his application. The letter indicated the specific criminal history as follows: Specifically, you [Petitioner] were arrested on April 21, 1980 by the Sheriff's Office, West Palm Beach, Florida and charged with Failure to Appear for Arraignment/Resisting Arrest with Violence. You were arrested on November 15, 1988 by the County Police, Mineola, New York, and charged with Driving While Intoxicated. You were arrested on December 30, 1988 by the County Police, Mineola, New York, and charged with Burglary Second Degree, and Criminal Possession of a Weapon. The disposition of these incidents are either unclear or not known. The letter requested, among other things, certain information regarding the arrests, including disposition, within 60 days. By letter dated April 7, 1998, Petitioner responded to Respondent's letter dated March 5, 1998. Petitioner provided certified copies of the courts' disposition records regarding the arrests in Respondent's letter dated March 5, 1998. Petitioner also indicated in his letter that he had mistakenly recalled that the charges were dismissed and, therefore, had not included them on his application. By letter dated May 6, 1998, Respondent notified Petitioner of its intent to deny his application for licensure based upon Petitioner's failure to establish that he possessed good moral character. Respondent indicated, among other things, the basis for its determination that Petitioner lacked good moral character, namely, Petitioner's failure to include any arrests on his application, his arrest record, and his response that he submitted to the arrest record. As to the arrest and charge on April 21, 1980, Petitioner pled guilty on June 23, 1980, to and was convicted of failure to appear for arraignment and a lesser charge of resisting arrest without violence. Adjudication was withheld and Petitioner was sentenced to six months probation. As to the arrest and charge on November 15, 1988, Petitioner pled guilty on January 5, 1989, to and was convicted of a lesser charge of operating a motor vehicle while impaired by alcohol. Petitioner was ordered to pay $250 or spend five days in jail, and his license was ordered revoked. As to the arrest and charge on December 30, 1988, Petitioner pled guilty on July 21, 1989, to and was convicted of a lesser charge of attempted petit larceny. The disposition was a conditional discharge.2 Respondent included another arrest in its letter dated May 6, 1998, which was not indicated in its letter dated March 5, 1998. The arrest occurred on December 9, 1984, when Petitioner was arrested by the Fort Lauderdale Police Department in Florida and charged with willful and wanton reckless driving. The disposition of that arrest was not established at hearing. It is undisputed that Petitioner failed to include any of the criminal history on his application for licensure. Even if Petitioner thought that the charges were dismissed, as he indicated in his response letter, the application provided Petitioner an opportunity to list the charges and to indicate that they were dismissed.

Recommendation Based on the foregoing Findings of Fact and Conclusions of Law, it is RECOMMENDED that the Department of Business and Professional Regulation, Community Association Managers, enter a final order denying the application of Jerry George Sardone, Jr., for licensure as a community association manager by examination. The Issue The issues in this case are whether Respondent violated Sections 943.1395(6) and (7), Florida Statutes (1995),1 and Florida Administrative Code Rules 11B-27.0011(4)(b) and (c),2 by failing to maintain the qualifications established in Section 943.13(7) for good moral character; and, if so, what, if any, penalty should be imposed.

Findings Of Fact Petitioner is the governmental agency responsible for certifying and regulating law enforcement officers in the state. Respondent is certified as a law enforcement officer pursuant to certificate number 139869 and is employed as a correctional officer by the Jacksonville Sheriff's Department (the "Department"). On January 23, 1994, Deputy J. W. Strickland observed Respondent in a parked vehicle in a vacant lot in an area of town known to the deputy as an area of drugs and prostitution. A white female was in the passenger seat of the vehicle. Deputy Strickland approached the vehicle and asked Respondent what he was doing in the area. Respondent identified himself as a correctional officer. Deputy Strickland recognized the female as Ms. Sherry Reinstzell. Ms. Reinstzell has a criminal history of prostitution. Deputy Strickland completed a field investigation report. Respondent and Ms. Reinstzell drove away. Deputy Strickland filed the field investigation report with the appropriate Department office. Sgt. Donald Retzer, Internal Affairs, received a copy of the field investigation report. He opened an internal affairs investigation concerning Respondent's conduct. Sgt. Retzer obtained a sworn statement from Respondent on January 28, 1994. Respondent stated under oath that he was just giving Ms. Reinstzell a ride to see a friend and did not know she was a prostitute. He denied any sexual activity with Ms. Reinstzell. Later in the same interview on January 28, 1994, Sgt. Retzer confronted Respondent with additional evidence previously gathered by Sgt. Retzer, including a sworn statement by Ms. Reinstzell. Respondent admitted that he picked Ms. Reinstzell up on Lane Avenue and negotiated a monetary arrangement for sex. Respondent then drove to an abandoned warehouse where Ms. Reinstzell performed fellatio on Respondent. Respondent paid Ms. Reinstzell $20 for the oral sex. He then drove her to a house where she used the $20 as part of the purchase price for illegal drugs with Respondent's knowledge.

Recommendation Based upon the foregoing Findings of Fact and Conclusions of Law, it is RECOMMENDED that Petitioner enter a Final Order finding Respondent not guilty of violating Section 943.1395(6), guilty of violating Section 943.1395(7) and Rule 11B-27.0011(4), and suspending Respondent's certificate for two years, including the period, if any, that Respondent has been unemployed by the Department prior to the date of this Recommended Order. ISIDRO R. CRUCET vs. DIVISION OF LICENSING, 81-002625 (1981)

Findings Of Fact On March 23, 1981, the Petitioner, Isidro R. Crucet, applied to the Respondent, Department of State, for licensure as a Class "D" (unarmed) and Class "G" (armed) security guard. The application for Class "D" and "G" licensure was denied on September 23, 1981, by the Director of the Division of Licensing pursuant to Section 493.306(2)(b)(1), 493.309(1)(e), 493.319(1)(a), (c), (g) and (p), Florida Statutes. On October 6, 1981, the Petitioner Crucet requested a hearing on the licensure denial. The basis for the Department's denial was the Petitioner's guilty plea on April 24, 1981, on a charge of carrying a concealed weapon following an information being filed against him in Dad County Circuit Court on April 5, 1981, which alleged violations of Section 790.01, Florida Statutes, carrying a concealed firearm, and Section 790.10, Florida Statutes, improper exhibition of a dangerous weapon. Following his guilty plea, the Petitioner Crucet was sentenced to eighteen months probation beginning April, 1981, and adjudication and sentence were withheld. At the final hearing, the Petitioner Crucet, through his interpreter, explained the events which led to his being charged and convicted of carrying a concealed firearm. Since early 1981, the Petitioner has been employed by Minutemen Security Patrol. In April, 1981, he was working the 6:00 p.m.-6:00 a.m. shift guarding a warehouse located at 3050 North River Drive in Miami. Adjacent to the warehouse area which he was guarding was a bar. A patron of the bar wanted to park his car in the warehouse area which the Petitioner was guarding since the bar parking area was full. When the Petitioner refused to allow the bar patron to park in the warehouse parking area, the patron became abusive and threatening. After the bar patron grabbed his neck and shoved him aside, the Petitioner went to his car and returned carrying a 33 caliber gun retrieved from the glove compartment which was lawfully purchased and for which he had received a temporary gun permit. When he reached the area where the bar patron had threatened him and the individual saw the gun, he left in his car. Although the gun was loaded, the Petitioner did not point the gun at anyone nor did he leave the area he was responsible for guarding. Approximately one hour after the incident the police arrived at the warehouse and asked the Petitioner if he had a gun. The Petitioner replied that he did and turned the gun over to the police. He was then arrested and booked on April 5, 1981. The Petitioner arrived in the United States from Cuba on May 1, 1980. He testified that while in Cuba he had worked on trains. He is presently working as an unarmed security guard for the same company which employed him when the incident in question occurred. Since the Petitioner arrived from Cuba, it is impossible at this time for the Respondent Department of State to ascertain from official records his criminal history in that country, if any. In this regard, the Petitioner is not unique and this is a situation that confronts all entrants from countries with whom the United States does not maintain formal or informal diplomatic relations. The Petitioner Crucet produced affidavits from individuals who were friends and neighbors in Cuba and who now reside in the United States. All of these individuals, who include an auto store clerk, a grocery store owner, a Community Service Agency owner and a supermarket owner, attest to his good moral character in Cuba and in the United States since his arrival in 1980. Additionally, the Petitioner's attorney, Jorge Fernandez, testified at the formal hearing that he knew the Petitioner, his family and his employer and would vouch for the good moral character and reputation of the Petitioner. Counsel for the Petitioner informed the Hearing Officer at the close of the final hearing that one of the conditions of his probation prohibit him from receiving a license as an armed security guard without the permission of his probation officer. However, once the Petitioner's probationary period has ended, it is the intention of Mr. Fernandez to attempt to expunge the Petitioner's record and reapply for a license as an armed security guard. The Respondent Department of State offered no evidence to refute the Petitioner's account of the incident which resulted in his guilty plea for carrying a concealed weapon or the character affidavits filed following the close of the final hearing.

Recommendation Based on the foregoing findings of fact and conclusions of law, it is RECOMMENDED: That the application of Petitioner Isidro R. LYDIA DIAZ vs. DEPARTMENT OF LAW ENFORCEMENT, 88-006422 (1988)

Findings Of Fact Background In June 1988, respondent, Florida Department of Law Enforcement, Criminal Justice standards and Training Commission (Commission), acting on a tip from the local media that intervenor, Metropolitan Dade County, Department of Corrections and Rehabilitation (County), had in its employ a number of corrections officers who were not certified, undertook a review of the County's employment records. Following a comparison of the County's records and those of the Commission, the Commission identified 363 individuals, including the petitioner, who were employed by the County as correctional officers but who had not been certified by the Commission. On August 10-11, 1988, Commission personnel visited the County's personnel office, and audited the personnel file of each of the 363 individuals in question. The audit demonstrated that the files were disorganized, lacking documentation required by Rule 11B-27.002, Florida Administrative Code, to apply for certification, and that the County had failed to apply for certification on behalf of the 363 officers.2/ Over the course of their two-day visit, the Commission's personnel set up an "assembly line" and, together with the County's staff, attempted to complete the documentation on each file. Variously, registration forms and affidavits of compliance were prepared, and birth certificates, fingerprint cards and other missing documentation was assembled. On August 12, 1988, the Commission's personnel returned to Tallahassee with the subject registration forms and affidavits of compliance. Over the course of time, these applications were processed and the vast majority of the individuals were certified; however, the Commission declined, for reasons hereinafter discussed, to certify petitioner. The pending application Petitioner, Lydia Diaz (Diaz), has been employed by the County as a correctional officer since February 26, 1988, without benefit of certification. On August 10, 1988, as a consequence of the aforementioned audit, the County, as the employing agency, applied for certification on behalf of Diaz.3/ Accompanying the application (registration) was an affidavit of compliance, dated February 26, 1988, signed by Fred Crawford, Director of Metropolitan Dade County, Department of Corrections and Rehabilitation, which comported with existing law and which certified that such employing agency had collected, verified, and was maintaining on file evidence that Diaz had met the provisions of Section 943.13(1)-(8), and Section 943.131, Florida Statutes, or any rules adopted pursuant thereto. Among the provision of section 943.13 is the requirement that the applicant be of good moral character. By letter dated November 7, 1988, the Commission notified Diaz and the County that her application for certification as a correctional officer was denied for lack of good moral character because: You unlawfully and knowingly obtained or used or endeavored to obtain or to use clothing, the property of Burdines with the intent to either temporarily or permanently deprive the owner of a right to the property or a benefit there from or to appropriate the property to your own use or to the use of any person not entitled thereto. You have unlawfully and knowingly possessed and introduced into your body cannabis. Following receipt of the Commission's letter of denial, Diaz filed a timely request for a formal hearing pursuant to Section 120.57(1), Florida Statutes. In her request for hearing, Diaz denied that she failed to possess the requisite good moral character necessary for certification. Good moral character Pursuant to Rule 11B-27.0011, Florida Administrative Code, the County, as the employing agency, is responsible for conducting a thorough background investigation to determine the moral character of an applicant. Consistent with such mandate, the County routinely uses previous employment data, law enforcement records, credit agency records, inquiries of the applicant's neighbors and associates, and a pre-employment interview, at which a polygraph examination is administered, to assess an applicant's moral character. In assessing an applicant's character, the County is bound by the provisions of Rule 11B-27.0011(2), Florida Administrative Code, which provides: The unlawful use of any of the controlled substances enumerated in Rule 11B-27.00225 by an applicant for certification, employment, or appointment at any time proximate to such application for certification, employment, or appointment conclusively establishes that the applicant is not of good moral character as required by Section 943.13(7). The unlawful use of any of the controlled substances enumerated in Rule 11B-27.00225 by an applicant at any time remote from and not proximate to such application may or may not conclusively establish that the applicant is not of good moral character, as required by Section 943.13(7), depending upon the type of controlled substance used, the frequency of use, and the age of the applicant at the time of use. Nothing herein is intended, however, to restrict the construction of Section 943.13(7), only to such controlled substance use. The substances enumerated in rule 11B-27.00225 are amphetamines, barbiturates, cannabis (marijuana), opiates, cocaine, phencyclidine, benzodiazepines, and methaqualone. Pertinent to this case, Diaz filed an application with the County for employment as a correctional officer on October 8, 1987. Her application disclosed that she had used marijuana, the last time being in July 1987, and that she had been arrested for petit theft in 1979, but had not committed the offense. Regarding her use of marijuana, the proof demonstrates that Diaz did use marijuana on one occasion in July 1987. At the time, Diaz had been out to dinner with some girl friends, after which they stopped by an acquaintance's home to socialize. Upon arrival, someone was smoking marijuana and asked her to have some. Diaz initially refused, but upon the insistence of the group took a puff and passed it on to someone else. Other than this limited contact with marijuana, Diaz has only used the substance twice in her life, and that occurred at home, during the course of one evening, with her first husband in 1975. At that time, Diaz smoked marijuana, at her first husband's request, while they watched television that evening. But for this limited use, Diaz has not otherwise used marijuana or any other controlled substance. Regarding her arrest in March 1979 for petit theft, the proof demonstrates that such charges were dismissed and that Diaz did not commit the offense. Under the provisions of rule 11B-27.0011(2), the use of a controlled substance does not conclusively establish that an applicant lacks the good moral character necessary for certification unless such use was "proximate" to her application. The Commission has not defined the term "proximate," and offered no proof at hearing as to what it considers "proximate" usage within the meaning of rule 11B-27.0011(2). Variously, the law enforcement agencies of the state have been left with no definitive guideline from the Commission, and have adopted various standards. Pertinent to this case, Dade County has adopted a term of one year as the standard by which it gauges the "proximate" use of a controlled substance to an application for employment. Under such policy, an applicant who has refrained from such use for at least one year preceding application will not be automatically rejected as lacking good moral character. Rather, the applicant's entire background will be evaluated to determine whether she currently possesses the requisite moral character for employment. Here, Diaz, born November 2, 1955, used marijuana in July 1987, only 7 months before her employment by the County as a correctional officer. Such use was, by the County's own interpretation of the rules, proximate to her employment and should have resulted in the rejection of her application. Fred Crawford, then Director of Metropolitan Dade County, Department of Corrections and Rehabilitation, made, however, an exception in Diaz' case, since her mother was an employee of long standing with his office, and employed her on the condition that she refrain from the use of any controlled substance and that she excel in her performance. Diaz has satisfied both conditions. Following her employment in February 1988, Diaz was graduated first in a class of 40 correctional officers from the academy. She was certified by the Commission on June 17, 1988, for completion of the 675-hour basic correctional officer course, and on October 13, 1988, for the 40-hour advanced report writing and review course. To date, Diaz has been employed by the County as a correctional officer, a position of trust and confidence, for over one year. Her evaluations have been above satisfactory, and her periodic drug screenings have all met with negative results. By those who know of her, she is considered an excellent employee, observant of the rules, honest, fair and respectful of the rights of others. Apart from her exceptional performance as a correctional officer, Diaz has other traits that reflect well on her moral character. Currently she is remarried and the mother of three children. By those who know of her, she maintains a good home and is an excellent parent. In addition to her other responsibilities, she attends night school at Miami-Dade Community College, where she has made the Dean's list for having achieved all "A's" the last two terms. Diaz is also current on all her obligations, and enjoys a good credit reputation in the community. While Diaz' use of marijuana in July 1977 was proximate to her employment by the County, and should have resulted in the rejection of her application, this proceeding is a de novo hearing on her application for certification, and her qualifications are, therefore, evaluated as of the date of hearing. Here, her use of marijuana two times, the last time being almost 2 years ago, is not proximate or frequent within the meaning of rule 11B- 27.0011(2), or persuasive evidence of bad moral character.4/ Rather, Diaz has demonstrated, on balance, that she possesses the requisite good moral character for certification.

Recommendation Based on the foregoing findings of fact and conclusions of law, it is RECOMMENDED that the application of petitioner, Lydia Diaz, for certification as a correctional officer be approved. The pending application Petitioner, Roberto Mera (Mera), has been employed by the County as a correctional officer for approximately two years, without benefit of certification. On August 10, 1988, as a consequence of the aforementioned audit, the County, as the employing agency, applied for certification on behalf of Mera. 3/ Accompanying the application (registration) was an affidavit of compliance, dated August 10, 1988, signed by Fred Crawford, Director of Metropolitan Dade County, Department of Corrections and Rehabilitation, which comported with existing law and which certified that such employing agency had collected, verified, and was maintaining on file evidence that Mera had met the provisions of Section 943.13(1)-(8), and Section 943.131, Florida Statutes, or any rules adopted pursuant thereto. Among the provision of section 943.13 is the requirement that the applicant be of good moral character. By letter dated November 1, 1988, the Commission notified Mera and the County that his application for certification as a correctional officer was denied for lack of good moral character because: You have unlawfully and knowingly possessed and introduced into your body cocaine and cannabis. You have unlawfully and knowingly purchased stolen property. Following receipt of the Commission's letter of denial, Mera filed a timely request for a formal hearing pursuant to Section 120.57(1), Florida Statutes. In his request for hearing, Mera denied that he failed to possess the requisite good moral character necessary for certification. Good moral character Pursuant to Rule 11B-27.0011, Florida Administrative Code, the County, as the employing agency, is responsible for conducting a thorough background investigation to determine the moral character of an applicant. Consistent with such mandate, the County routinely uses previous employment data, law enforcement records, credit agency records, inquiries of the applicant's neighbors and associates, and a pre-employment interview, at which a polygraph examination is administered, to assess an applicant's moral character. In assessing an applicant's character, the County is bound by the provisions of Rule 11B-27.0011(2), Florida Administrative Code, which provides: The unlawful use of any of the controlled substances enumerated in Rule 11B-27.00225 by an applicant for certification, employment, or appointment at any time proximate to such application for certification, employment, or appointment conclusively establishes that the applicant is not of good moral character as required by Section 943.13(7). The unlawful use of any of the controlled substances enumerated in Rule 11B-27.00225 by an applicant at any time remote from and not proximate to such application may or may not conclusively establish that the applicant is not of good moral character, as required by Section 943.13(7), depending upon the type of controlled substance used, the frequency of use, and the age of the applicant at the time of use. Nothing herein is intended, however, to restrict the construction of Section 943.13(7), only to such controlled substance use. The substances enumerated in rule 11B-27.00225 are amphetamines, barbiturates, cannabis (marijuana), opiates, cocaine, phencyclidine, benzodiazepines, and methaqualone. Pertinent to this case, the County undertook a pre-employment interview of Mera on April 16, 1987, at which time he divulged that he had used marijuana one time in 1977, that he had used cocaine one time in 1982, and that he had purchased a stolen VCR for $100 in 1982. While the used VCR he purchased was apparently stolen property, Mera did not know such fact when he purchased it, and turned it over to the police when they advised him it was stolen property. Other than heretofore noted, Mera has never used marijuana or cocaine. Notwithstanding the County's conclusion, based on its investigation and analysis of Mera's background, that Mera possessed the requisite good moral character for employment and certification, the Commission proposed to deny certification based on the foregoing isolated incidents. The Commission's action is unwarranted. Here, Mera, born August 20, 1963, used marijuana one time 12 years ago when he was 14-15 years of age, and cocaine one time 7 years ago when he was 19 years of age. At no time did he knowingly purchase stolen property. Such isolated and dated usage of marijuana and cocaine can hardly be termed proximate or frequent within the meaning of rule 11B-27.0011(2), or persuasive evidence of bad moral character. 4/ To date, Mera has been employed by the County as a corrections officer, a position of trust and confidence, for approximately two years. His annual evaluations have ranged from above satisfactory to outstanding, and his periodic drug screenings have all met with negative results. By those who know of him, he is considered an excellent employee, observant of the rules, honest, fair and respectful of the rights of others. Overall, Mera has demonstrated that he possessed the requisite good moral character when he was employed by the County as a correctional officer, and has demonstrated in this de novo proceeding that he currently possesses the requisite good moral character for certification.

Recommendation Based on the foregoing findings of fact and conclusions of law, it is RECOMMENDED that the application of petitioner, Roberto Mera, for certification as a correctional officer be approved. The Issue The issue for determination is whether Petitioner’s request for exemption from employment disqualification should be granted.

Findings Of Fact On April 30, 1996, James L. Wilson was arguing with his wife. Mr. Wilson’s stepson entered into the argument. The stepson was 15 years old. Mr. Wilson, using his open hands, pushed his stepson in the chest, causing his stepson to fall over a chair and onto the floor. This incident occurred in Richmond County, Georgia. As a result of Mr. Wilson’s action against his stepson, Mr. Wilson was arrested and charged with a misdemeanor offense of simple battery. On May 1, 1996, Mr. Wilson pled guilty to the simple battery charge before the court in Richmond County, Georgia, and was sentenced to 12 months' probation and ordered to pay a fine of $150. As conditions for his probation, Mr. Wilson was ordered to have no violent contact with his stepson and to pay $20 per month for probation supervision fees. Subsequently, Mr. Wilson’s relationship with his stepson greatly improved. Mr. Wilson and his stepson get along well with one another. In July 1997, Mr. Wilson began employment with Corrections Corporation of America (CCA) in the State of Florida to assist CCA in the establishment of a program for juveniles in Florida. He was transferred by CCA from the State of South Carolina where he worked with juveniles for CCA. CCA is a contract provider with the State of Florida, Department of Juvenile Justice (Department). Working in Florida, Mr. Wilson was a shift commander at CCA’s Okeechobee Youth Offender Camp in Okeechobee, Florida. As shift commander, he supervised six staff members, supervisors of two main shifts, and 50 juvenile offenders. Mr. Wilson worked directly with juveniles. Subsequently, Mr. Wilson became the assistant maintenance/training officer, training staff at CCA’s Okeechobee Redirect Center for Juvenile Offenders. Mr. Wilson worked directly with juveniles. Mr. Wilson was in a caretaker position with CCA at both locations. Being in the positions with CEA in Florida, Mr. Wilson was required to make application for a caretaker position with CCA. In conjunction with the application, the Department required Mr. Wilson to submit to a background screening conducted by the Department’s Background Screening Unit, Bureau of Investigations (Screening Unit). Only a Florida criminal history check was conducted by the Screening Unit, which revealed no criminal history for Mr. Wilson. As part of the background screening process, Mr. Wilson was required to sign and submit two notarized affidavits (Affidavit of Good Moral Character), which were dated July 7, 1997, and December 31, 1997, respectively. On both affidavits, Mr. Wilson indicated that he had no disqualifying offenses that would deem him ineligible to work in direct contact with juveniles. Listed on each affidavit, as one of the disqualifying offenses, was "battery, if the victim of the offense was a minor," which is the offense for which Mr. Wilson was convicted in May 1996 in Richmond County, Georgia. Neither affidavit stated as to whether the offense was a misdemeanor or felony. Before signing each affidavit, Mr. Wilson communicated with his supervisor at CCA. He explained to his supervisor about the misdemeanor and queried his supervisor as to whether he should indicate that he had a disqualifying offense. Mr. Wilson’s supervisor advised him that the focus of the affidavits was on felonies. Even though neither affidavit stated that the offenses were misdemeanors or felonies, Mr. Wilson indicated that he had no disqualifying offense. In completing the affidavits, Mr. Wilson had no intention to deceive. However, the responsibility was upon Mr. Wilson to complete the affidavits and to complete them accurately and honestly. He should have known to indicate on the affidavits that he had a disqualifying offense in the absence of the affidavits stating whether the offenses were misdemeanors or felonies. After Mr. Wilson began working in Florida with CCA, he was also required to undergo a state and federal fingerprint check. The fingerprint checks revealed the simple battery on his stepson and also revealed a 1995 arrest for a misdemeanor simple battery in the State of Georgia, which was nolle prossed. By letter dated February 22, 1999, Mr. Wilson was notified by the Screening Unit’s supervisor of his potential disqualification from employment based upon the two arrests revealed by the fingerprint checks. The letter included identifying information regarding the arrests. The Screening Unit's supervisor requested that Mr. Wilson submit certified copies of arrest reports, court dispositions, and other court documents regarding the two arrests. Mr. Wilson complied and subsequently submitted the requested information. The Department reviewed the information. The Department determined that Mr. Wilson was ineligible for continued employment in a position of special trust based upon the May 1, 1996, misdemeanor simple battery against his stepson. By letter dated April 29, 1999, the Screening Unit’s supervisor notified Mr. Wilson that he was ineligible and that he could request an exemption from disqualification. CCA was also notified simultaneously of Mr. Wilson’s ineligibility and was instructed to immediately remove him from direct contact with juveniles. CCA removed Mr. Wilson from direct contact with juveniles. Mr. Wilson requested an informal exemption hearing, which was held on June 8, 1999. The hearing was conducted by a committee of two individuals, who only had the authority to make a recommendation to the Inspector General who had final decision-making authority. In a report dated June 16, 1999, the committee recommended that, although Mr. Wilson had rehabilitated himself, his exemption be denied based upon his falsification of the two notarized affidavits. 1/ The committee’s recommendation, along with the entire background screening file, was forwarded to the Department’s Inspector General. After reviewing the recommendation and the file, the Inspector General denied Mr. Wilson’s request for exemption. The Inspector General denied the exemption on three grounds. First, Mr. Wilson’s falsification of the two notarized affidavits was proof of Mr. Wilson’s lack of good moral character and of rehabilitation. Second, an insufficient amount of time had elapsed since Mr. Wilson’s commission of simple battery on his stepson, a minor, to establish good moral character and rehabilitation. Third, Mr. Wilson failed to show that he had successfully completed his probationary period regarding his conviction of simple battery on his stepson. By letter dated June 22, 1999, the Inspector General notified Mr. Wilson that his request for exemption was denied.

Recommendation Based on the foregoing Findings of Fact and Conclusions of Law, it is RECOMMENDED that the Department of Juvenile Justice enter a final order denying James Wilson an exemption from disqualification of employment to work in a position of special trust or responsibility with it. The Issue At issue in this proceeding is whether petitioner possesses the requisite good moral character for certification as a correctional officer.

Findings Of Fact Background In June 1988, respondent, Florida Department of Law Enforcement, Criminal Justice Standards and Training Commission (Commission), acting on a tip from the local media that intervenor, Metropolitan Dade County, Department of Corrections and Rehabilitation (County), had in its employ a number of corrections officers who were not certified, undertook a review of the County's employment records. Following a comparison of the County's records and those of the Commission, the Commission identified 363 individuals, including the petitioner, who were employed by the County as correctional officers but who had not been certified by the Commission. On August 10-11, 1988, Commission personnel visited the County's personnel office, and audited the personnel file of each of the 363 individuals in question. The audit demonstrated that the files were disorganized, lacking documentation required by Rule 11B-27.002, Florida Administrative Code, to apply for certification, and that the County had failed to apply for certification on behalf of the 363 officers. 2/ Over the course of their two-day visit, the Commission's personnel set up an "assembly line" and, together with the County's staff, attempted to complete the documentation on each file. Variously, registration forms and affidavits of compliance were prepared, and birth certificates, fingerprint cards and other missing documentation was assembled. On August 12, 1988, the Commission's personnel returned to Tallahassee with the subject registration forms and affidavits of compliance. Over the course of time, these applications were processed and the vast majority of the individuals were certified; however, the Commission declined, for reasons hereinafter discussed, to certify petitioner. The pending application Petitioner, Alfonso Morales (Morales), has been employed by the County as a correctional officer since June 30, 1986, without benefit of certification. On August 11, 1988, as a consequence of the aforementioned audit, the County, as the employing agency, applied for certification on behalf of Morales. 3/ Accompanying the application (registration) was an affidavit of compliance, dated August 11, 1988, signed by Fred Crawford, Director of Metropolitan Dade County, Department of Corrections and Rehabilitation, which comported with existing law and which certified that such employing agency had collected, verified, and was maintaining on file evidence that Morales had met the provisions of Section 943.13(1)-(8), and Section 943.131, Florida Statutes, or any rules adopted pursuant thereto. Among the provision of section 943.13 is the requirement that the applicant be of good moral character. By letter dated November 7, 1988, the Commission notified Morales and the County that his application for certification as a correctional officer was denied for lack of good moral character because: You have unlawfully and knowingly carried a concealed firearm. You have unlawfully and knowingly possessed and introduced into your body cannabis. Following receipt of the Commission's letter of denial, Morales filed a timely request for a formal hearing pursuant to Section 120.57(1), Florida Statutes. In his request for hearing, Morales denied that he failed to possess the requisite good moral character necessary for certification. Good moral character Pursuant to Rule 11B-27.0011, Florida Administrative Code, the County, as the employing agency, is responsible for conducting a thorough background investigation to determine the moral character of an applicant. Pertinent to this case, the County undertook a pre-employment interview of Morales on December 18, 1985, at which time he divulged that, as to arrests, he had been arrested one time in 1980 for carrying a concealed weapon and that, as to drug usage, he had used marijuana one time "many, years ago." Regarding the use of marijuana, the proof demonstrated that Morales had used it but once, and that was in 1976, when he was 17 years old and attending high school. Regarding his arrest for carrying a concealed weapon, the proof demonstrates that in August 1980, Morales was stopped while driving in the City of Miami Beach for a "routine traffic offenses (unsafe equipment)." Following the stop, Morales volunteered to the officers that he had a .25 caliber automatic pistol under the driver's seat which, upon discovery by the officers, resulted in his arrest. No charges were filed, however, as a consequence of that arrest, and Morales' arrest record was expunged and sealed by court order in August 1985. Notwithstanding the County's conclusion, based on its investigation and analysis of Morales' background, that Morales possessed the requisite good moral character for employment and certification, the Commission proposed to deny certification based on the foregoing incidents. The Commission's action is not warranted by the proof. Here, Morales, born March 9, 1959, used marijuana one time, 13 years ago when he was 17 years of age. Such isolated and dated usage can hardly be termed proximate or frequent within the meaning of rule 11B-27.0011(2), or persuasive evidence of bad moral character. Nor, can Morales' arrest for carrying a concealed weapon, considering what has occurred in his life since that time, be considered persuasive proof, if it ever was, of bad moral character. 4/ Morales graduated from high school in 1981, and entered the U.S. Army in 1982 where he served honorably for over three years. During his service he attained the rank of sergeant, enjoyed a top secret security clearance, garnered several commendations, and all drug screenings met with negative results. Following his discharge from the services, Morales was employed by the State of Florida, Job Services of Florida, until his employment by the County. To date, Morales has been employed by the County as a corrections officer, a position of trust and confidence, for almost three years. His annual evaluations have ranged from above satisfactory to outstanding, and his periodic drug screenings have all met with negative results. By those who know of him, he is considered an excellent employee, observant of the rules, honest, fair and respectful of the rights of others. Overall, Morales has demonstrated that he possessed the requisite good moral character when he was employed by the County as a correctional officer, and has demonstrated in this de novo proceeding that he currently possesses the requisite good moral character for certification.

Recommendation Based on the foregoing findings of fact and conclusions of law, it is RECOMMENDED that the application of petitioner, Alfonso Morales, for certification as a correctional officer be approved. The Issue Should Petitioner impose discipline on Respondent in association with his correctional certificate?

Findings Of Fact Respondent was certified by the Criminal Justice Standards and Training Commission on October 29, 1997, and was issued correctional certificate No. 175702. At times relevant to the inquiry Respondent was employed at the Gadsden Correctional Facility as a Senior Correctional Officer. Corrections Corporation of America (CCA) ran Gadsden Correctional Facility during the period in question. On February 26, 20004, on a medical enrollment worksheet for insurance provided by CCA, Respondent wrote in the name Tamara S. Ross and identified Tamara Ross as his wife. Similarly, on a dental/disability worksheet for insurance executed on the same date, Respondent wrote the name Tamara S. Ross, in a block within the form which was intended for use in identifying the applicant's spouse. In both insurance plans Respondent, by executing the applications, had added Tamara S. Ross to the coverage. When placing his signature on the application forms to add Tamara S. Ross to the coverage he confirmed, consistent with each form, "I am also certifying that all of the information, including dependent information, that I have provided on this form is accurate." At the time the applications were made requesting that Tamara S. Ross be added for medical and dental/disability coverage as Respondent's wife, the person identified as Tamara S. Ross was not the wife of Respondent. At an earlier time she had identified herself as Tamara Moore. In a document found within Respondent's personnel file maintained by his employer CCA, a reference is made to "Tamara" who is described as "my fiancée." On November 11, 2004, Respondent resigned his position as Senior Correctional Officer at the Gadsden Correctional Facility.

Recommendation Upon consideration of the facts found and conclusions of law reached, it is RECOMMENDED: That a Final Order be entered finding violations pertaining to Sections 838.022 and 943.1395(7), Florida Statutes (2003), and Florida Administrative Code Rule 11B-27.0011(4)(a), while dismissing the part of the case referring to Section 943.1395(6), Florida Statutes (2003), and suspending the correctional certificate held by Respondent for 30 days. The Issue The issue to be determined is whether Respondent, Larry A. Labay, failed to maintain good moral character as alleged in the Administrative Complaint, in violation of section 943.1395(7), Florida Statutes (2010), and Florida Administrative Code Rule 11B-27.0011(4)(a) and (b). If so, then the appropriate penalty to be imposed must also be determined.

Findings Of Fact Respondent is a certified correctional officer licensed by the Criminal Justice Standards and Training Commission. He received his correctional certificate, number 285033, on July 17, 2009. Respondent was employed by the Clay County Sheriff’s Office (CCSO) from February 16, 2010, through July 18, 2011. Respondent was in a relationship with a woman named Marissa Meszaros. Their relationship began in approximately May of 2011. Ms. Meszaros was the subject of an investigation by the narcotics unit of CCSO, which believed that she might be involved in selling narcotics. A confidential informant had been used to make controlled purchases of controlled substances from Ms. Meszaros. During the course of the investigation into Ms. Meszaros, the drug task force learned that a possible CCSO employee was at the scene of some of the controlled purchases. A video recording of some of the buys showed Respondent directly in front of an illegal drug transaction. As a result, Respondent’s conduct was also investigated. On June 27, 2011, Respondent and Ms. Meszaros were observed riding in Respondent’s red 2000 Dodge pickup truck in the Orange Park area. They were observed leaving the Orange Park mall and going into an area known as a high drug-traffic area, and then south on Blanding Boulevard toward Labay’s residence. Once Respondent left Orange Park and returned from Duval County to Clay County, Detective Mark Maertz stopped Labay’s vehicle because the tag for his truck had expired. Detective Maertz was part of the CCSO’s canine unit. Once the truck was stopped, Detective Maertz deployed his dog, Rex, who alerted to the presence of narcotics. Detective Maertz requested that Respondent and Ms. Meszaros exit the car, and they did so. Ms. Meszaros was found to have crack cocaine in her bra. (A female officer dealt with her at the scene.) Also discovered were trace amounts of a green leafy substance throughout the floorboard on the driver’s side of the truck. The substance was in plain view of anyone getting into the driver’s side of car. As a result of their training and experience, both Detective Maertz, who stopped the car, and Sergeant Shawn Gordon, who actually conducted the search of the truck, recognized the substance as marijuana or cannabis, also referred to as “shake.” Respondent was detained and questioned following the traffic stop. He was questioned after being given his Miranda rights. He also gave consent to a search of his residence. At the beginning of the interview, Respondent denied ever using drugs or seeing Ms. Meszaros using drugs. However, after some questioning, Respondent admitted to giving Meszaros money to buy drugs and seeing her use them. A search of his residence resulted in the discovery of a “bong,” or pipe used to smoke marijuana, in the common bathroom, and a crack pipe in the master bedroom. The marijuana pipe was in plain view in the hall bathroom. The crack pipe was in a cigarette box on the dresser in the master bedroom. Respondent told the detectives who questioned him that they would find the drug paraphernalia in his home. The home was owned by Respondent. Ms. Meszaros had recently moved in with Respondent.

Recommendation Based on the foregoing Findings of Fact and Conclusions of Law, it is RECOMMENDED that the Criminal Justice Standards and Training Commission enter an Order finding that Respondent has failed to maintain good moral character as defined in rule 11B- 27.0011(4)(b) in violation of section 943.1395(7), and revoking his certification as a correctional officer. The Issue Whether Respondent committed the offense set forth in the Administrative Complaint and, if so, what penalty should be imposed.

Findings Of Fact At all times material to this case, Savage is a certified correctional officer in the State of Florida. As such, he holds a position of high trust. Savage abused that trust by lying on his application for employment as a court bailiff in Palm Beach County. The deception came to light between March 4, 2002, and April 15, 2002, when Elizabeth McElroy (McElroy) in her official capacity as background investigator for the Palm Beach County Sheriff’s Office, attempted to verify information provided under oath by Savage, and to search law enforcement databases to assure that he had been truthful in claiming that he had no criminal record. Instead, McElroy's investigation revealed that Savage failed to disclose two arrests, one of which involved the use of a firearm. Florida law requires, as a minimum qualification for its correctional officers, that they be of good moral character. Florida law further provides that officers who lack good moral character, or who make false statements under oath, may be stripped of their license to serve in law enforcement. The public has every right to expect that those who work in law enforcement will, at a minimum, tell the truth under oath. Individuals can be rehabilitated and can go on to occupy positions of trust, but that decision is to be made by duly authorized licensing authorities acting upon complete information. It should not be necessary for a background investigator to have to unearth information which the individual concealed on an employment application.

Recommendation Based on the foregoing Findings of Fact and Conclusions of Law, it is RECOMMENDED that Savage's correctional certificate be permanently revoked.
