Findings Of Fact The Petitioner testified in his own behalf, admitting that he had failed to answer Question 13, "Have you ever been arrested?" honestly. He stated that he had been embarrassed to put down the fact that he had been arrested. He stated that he had applied for the position as an unarmed security guard with Oxford Security Services thinking that it would be a temporary position. However, since his employment he has been promoted to safety coordinator, salesman and supervisor/operations manager of the company's operations in the Jacksonville area. The applicant was first employed in June of 1979. He stated that he needed to be licensed in order to maintain his present position. The applicant explained his arrest in 1963 and in 1977. His arrest in 1963 was for larceny and arose from taking money belong to the company by which he was employed and purchasing a car with it. The court withheld adjudication and placed the applicant on probation for five years. During that time he married and left the State of Florida in violation of the terms of his probation. In 1977, the applicant was employed in Jacksonville, Florida, as a used car salesman. After a 24-hour sale-athon, the applicant began bar-hopping and ended up in a topless go-go club. His next conscious recollection was waking up in the Duval County jail, where he was advised that he was charged with lewd and lascivious conduct. He had no knowledge of the conduct which gave rise to his arrest. The Duval County court advised the applicant to enter a plea of nolo contendere and be transferred to Miami court for disposition of the applicant's offense of parole violation. The Duval County court sentenced the applicant to two days for lewd and lascivious conduct, during which time he was transferred to the Dade County courts. The charges of violating parole in Dade County were dismissed. The applicant further explained his arrest for passing a worthless bank check. The applicant stated that he had overdrawn his account unknowingly in 1971. He was arrested and paid off the overdraft, and the charge was dismissed. The applicant stated that his employer was not aware of his arrest record.
Recommendation Based upon the foregoing Findings of Fact and Conclusions of Law, the Hearing Officer recommends that the applicant's application for a Class F, unarmed guard license be denied; however, that the applicant be afforded the opportunity to refile his application with full disclosure, and that in the absence of any other disqualifying grounds said reapplication be approved. Findings Of Fact The Respondents. The Respondent, Fred Peel, is the Sheriff of Washington County, Florida. (Stipulated Fact). Sheriff Peel has continuously served as the Sheriff of Washington County for the past fifteen years. (Stipulated Fact). Sheriff Peel is an elected official. (Stipulated Fact). At all times relevant to this proceeding, Sheriff Peel served as a public officer subject to Section 112.313(6), Florida Statutes. The Respondent, John Jenkins, is a captain with the Washington County Sheriff's Department. (Stipulated Fact). Captain Jenkins has continuously served with the Sheriff's Department for ten years. (Stipulated Fact). Captain Jenkins was appointed by Sheriff Peel pursuant to Chapter 30, Florida Statutes. (Stipulated Fact). At all times relevant to this proceeding, Captain Jenkins served as a public officer subject to Section 112.313(6), Florida Statutes. The Arrest of the Complainant. The complainant, Timothy Hinson, was arrested by a deputy of the Washington County Sheriff's Office on November 26, 1990. Mr. Hinson was charged with driving under the influence, driving while license suspended or revoked and refusal to sign citation. (Stipulated Fact). At the time of his arrest, Mr. Hinson was intoxicated. Mr. Hinson's speech was slurred, his appearance was disheveled and his ability to understand verbal communication was poor. After being arrested and transported to the Washington County jail, Mr. Hinson made profane and abusive threats addressed to the arresting deputy and the "Sheriff". Mr. Hinson threatened to have the "Sheriff" removed. Mr. Hinson did not know who the Sheriff was at the time. Mr. Hinson's actions, failed to prove, as suggested by the Respondents, that Mr. Hinson had a vendetta against the Respondents or law enforcement personnel in general. This evidence merely proved that Mr. Hinson was drunk. The parties stipulated that, prior to his arrest on November 26, 1990, Mr. Hinson had been arrested six times since 1983. This evidence failed to prove, however, the Respondents' contention that Mr. Hinson had a grudge or vendetta against the Respondents or law enforcement personnel in general. This evidence suggests that Mr. Hinson has a drinking problem. Mr. Hinson's Effort to Obtain a Copy of His Arrest Record. Just prior to noon on December 28, 1990, Mr. Hinson went to the Washington County Sheriff's offices. Mr. Hinson went to the Sheriff's offices with the intent to obtain a copy of the records related to his arrest on November 26, 1990. (Stipulated Fact). Mr. Hinson was met in the lobby of the Sheriff's offices by Sharon Bellamy, an employee of Sheriff Peel. Mr. Hinson informed Ms. Bellamy that he wanted a copy of his arrest record. Mr. Hinson informed Ms. Bellamy that he needed a copy of the documents for his defense. Ms. Bellamy retrieved Mr. Hinson's file from the office where records were kept and brought it to the lobby to make the copies requested at a copy machine located in the lobby. There were two documents in the file that Mr. Hinson requested: the complaint and the arresting report. As Ms. Bellamy began to make a copy of the documents Mr. Hinson had requested, she found a copy of another document that had been mailed to Mr. Hinson that he had not requested. The document was a notice to Mr. Hinson that his Florida drivers' license had been suspended for refusing to take a breath test. Ms. Bellamy began quizzing Mr. Hinson about whether he had received the document. Although Mr. Hinson had in fact received the notice Ms. Bellamy asked him about, he told her he had not and requested a copy of it. Ms. Bellamy continued to ask Mr. Hinson about the notice. The conversation between Mr. Hinson and Ms. Bellamy became more agitated, although the evidence failed to prove why. Pam Miner, the Sheriff's secretary, was in an office next to the lobby. The door opening into the lobby was open and Ms. Miner overheard Ms. Bellamy and Mr. Hinson. Sheriff Peel was sitting in his office, which adjoined Ms. Miner's office. The door opening into Ms. Miner's office was also open and he could also hear the discussion. At some time after Ms. Bellamy began discussing the notice concerning Mr. Hinson's driver's license with him, Ms. Miner went to the door of Sheriff Peel's office and gave him a look which she described as intended to convey to Sheriff Peel that "you need to do something". After Ms. Miner looked into Sheriff Peel's office, he went out into the lobby. Sheriff Peel initially watched what was going on. At some point shortly after Sheriff Peel went into the lobby he asked Mr. Hinson some questions about Mr. Hinson's driver's license. Mr. Hinson informed Sheriff Peel that he had a Maryland driver's license. At some point during the discussion between Sheriff Peel and Mr. Hinson, Mr. Hinson indicated that he was seeking a copy of the documents in his file for his attorney. Sheriff Peel suggested that Mr. Hinson have his attorney get the copies. The discussion between Mr. Hinson and Sheriff Peel became more heated and argumentative. Eventually Sheriff Peel told Ms. Bellamy to "charge him $5.00" and started to leave. Mr. Hinson perceived this comment to mean that he was to be charged $5.00 per page or document. Prior to coming to the Sheriff's office to obtain copies of the documents in his file, Mr. Hinson had telephoned the Sheriff's office and had been told that there was a $2.00 copying charge. Two dollars is, in fact, what the Sheriff's office normally charges for copying documents. Mr. Hinson believed, therefore, that he would be charged $2.00 per document or a total of $4.00 for the documents he had requested. When Mr. Hinson heard the Sheriff indicate that he was to be charged $5.00, he became angry because he believed that Sheriff Peel was suggesting that he be charged $5.00 per copy or $5.00 per page. Such a charge was inconsistent with what he had been previously told about copying charges. Mr. Hinson incorrectly believed that Sheriff Peel was going to charge him the higher rate for copying because he had a Maryland drivers' license and was, therefore, apparently not from Washington County. Mr. Hinson confronted Sheriff Peel by stating that he had been told that the copying charge was only $2.00 a copy. Sheriff Peel, if he had meant to charge Mr. Hinson a total of $5.00 as suggested during the final hearing, did not clarify that he was only going to charge him a total of $5.00 instead of $5.00 per copy as Mr. Hinson apparently believed. The failure to clarify what he meant, and the fact that Sheriff Peel did not know how many documents were actually involved, support the conclusion that Sheriff Peel did not intend that Ms. Bellamy merely charge Mr. Hinson a total of $5.00. Of greater importance, these facts explain Mr. Hinson's confusion and anger. He reasonably believed he was going to be overcharged. Some time after Mr. Hinson confronted Sheriff Peel about the $5.00 charge, Sheriff Peel told Ms. Bellamy not to give Mr. Hinson anything. Mr. Hinson confronted Sheriff Peel, although he did not know at the time that he was the Sheriff, and asked him "what's the problem." Mr. Hinson also asked for the person in charge of "internal affairs", stating that he wanted to file a complaint against Sheriff Peel. Sheriff Peel informed Mr. Hinson that the Sheriff's Office did not have an "internal affairs" department, that he was the Sheriff, and that he would not take a complaint against himself. The Washington County Sheriff's Office has no written policy for handling complaints against personnel. The Washington County Sheriff's Office has an informal, unwritten policy for handling complaints. Sheriff Peel makes the final decision concerning complaints. At some time shortly after Sheriff Peel and Mr. Hinson began to argue, Captain Jenkins came to the door opening to the lobby from the room that he had been in. Initially, Captain Jenkins stood watching the discussion. Because of the smallness of the room, Captain Jenkins was relatively close to Mr. Hinson. After Sheriff Peel informed Mr. Hinson that there was no internal affairs department and that he would not take a complaint against himself, Captain Jenkins stated "I'm internal affairs this week. What's the problem?" or a statement to that effect. Although Captain Jenkins testified that he made the comment to try to diffuse the situation by injecting some humor into the situation, the weight of the evidence does not support this explanation. The weight of the evidence supports a conclusion that the comment was made in a snide and sarcastic manner. Mr. Hinson was being rude and confrontational. Sheriff Peel and Mr. Hinson were engaged in a somewhat heated argument. Mr. Hinson was obviously angry. To make such a statement to a person in this type situation evidenced a failure to exercise good judgement. The statement was intended to rebuke and insult Mr. Hinson. Mr. Hinson demanded that Captain Jenkins identify himself, which he did. Mr. Hinson told Captain Jenkins that he wanted to file a complaint against Sheriff Peel. Captain Jenkins told him that he would not take a complaint against the Sheriff. Captain Jenkins told Mr. Hinson that it would be better if he left the office. It was apparent to Mr. Hinson that nothing more could come of the confrontation with Sheriff Peel and Captain Jenkins. Sheriff Peel had ordered that nothing be given to Mr. Hinson. Sheriff Peel and Captain Jenkins had refused to take a complaint. It had been suggested that he leave. Mr. Hinson felt intimidated. Captain Jenkins is 6'1" and weighs approximately 225 pounds while Mr. Hinson is slightly built in comparison. There was nothing to be gained by continued argument and, therefore, Mr. Hinson left. Mr. Hinson was not intoxicated or taking medication at the time of his visit to the Sheriff's offices. Mr. Hinson's attitude and demeanor with Ms. Bellamy was defensive and confrontational. Mr. Hinson's displeasure over his arrest and his attitude were perceived as rudeness by Ms. Bellamy. Although Mr. Hinson did not yell or use profanity, as described by Ms. Bellamy, Mr. Hinson "had an attitude". These findings are based in large part upon the testimony of Ms. Bellamy, Pam Miner (the Sheriff's secretary) and David Corbin, the Director of Washington County Parks and Recreation. Mr. Corbin was in the lobby during the confrontation. Although Ms. Bellamy and Ms. Miner are employed by Sheriff Peel, and the fact that Ms. Bellamy was not totally candid in her testimony, the crucial elements of the testimony of the Respondents and these witnesses were consistent. It is difficult to categorize the degree of Mr. Hinson's rudeness. All of the witnesses agreed Mr. Hinson was rude and confrontational. His rudeness and attitude were not, however, so severe that Ms. Bellamy did not believe that she could handle Mr. Hinson. Nor did Ms. Bellamy ever feel threatened by Mr. Hinson. She did not request any assistance from Sheriff Peel or Captain Jenkins, both of whom were in adjoining offices. Nor was Mr. Hinson's attitude and treatment of Ms. Bellamy sufficiently troublesome to cause Captain Jenkins, who could hear the discussion between Ms. Bellamy and Mr. Hinson, to come out to assist Ms. Bellamy until after Sheriff Peel had intervened. Finally, Ms. Bellamy left the lobby during the confrontation to prepare to go to lunch, not something that would be expected of someone witnessing an overly serious confrontation. Sheriff Peel and Captain Jenkins did not yell at Mr. Hinson. Nor did they laugh at Mr. Hinson. Sheriff Peel did, however, become angry and argumentative with Mr. Hinson. The situation could have been ended by simply allowing Ms. Bellamy to provide the copies of the documents Mr. Hinson had requested, which had already been made. Captain Jenkins was sarcastic with Mr. Hinson and, to some degree, because of his size, intimidating to Mr. Hinson. Captain Jenkins' comment to Mr. Hinson, although sarcastic, was not threatening. Mr. Hinson, based upon 20-20 hindsight, was not a threat to anybody in the Sheriff's offices. This is not to say, however, that Mr. Hinson should have been taken lightly or that Mr. Hinson's conduct should have been totally accepted and tolerated by Sheriff Peel. Nor can it be concluded that Captain Jenkins should have totally ignored what was going on. Effort to Secure a Special Privilege, Benefit, or Exemption. The weight of the evidence failed to prove that the failure to have a written complaint procedure in place in the Washington County Sheriff's Office was intended by Sheriff Peel to secure a special privilege, benefit or exemption. Mr. Hinson, after telephoning the Florida Sheriff's Association, was informed that he could pick up a copy of the documents he wanted at the Sheriff's offices. Mr. Hinson also could have obtained a copy of the documents he wanted by having someone else, including his attorney, pick them up or by requesting a copy of the documents from the clerk of court's office. The weight of the evidence failed to prove that Sheriff Peel was attempting to intimidate Mr. Hinson into leaving the Sheriff's offices without obtaining a copy of the documents he had requested in order to secure a special privilege, benefit or exemption. Any funds collected for copying by the Sheriff's Office are funds of Washington County. Sheriff Peel has no control or direct use of those funds. The weight of the evidence failed to prove that Sheriff Peel was attempting to charge $5.00 for the copies in an effort to secure a special privilege, benefit or exemption. The weight of the evidence failed to prove that Captain Jenkins' actions were intended to intimidate Mr. Hinson into leaving the Sheriff's offices in order to secure a special privilege, benefit or exemption. At worst, the evidence proved that Sheriff Peel, arguably, could have exercised a little more patience and that Captain Jenkins made a smart remark at an inappropriate time. These actions, in light of Mr. Hinson's attitude and demeanor, do not support a conclusion that Sheriff Peel or Captain Jenkins were attempting to secure a special privilege, benefit or exemption for themselves or others. The actions of all those involved in this situation were emotional reactions to the situation and were not calculated to achieve any particular result.
Recommendation Based upon the foregoing Findings of Fact and Conclusions of Law, it is RECOMMENDED that the Commission on Ethics enter a Final Order and Public Report dismissing Complaint No. 91-42 and Complaint No. 91-43. The Issue Whether Petitioner has cause to terminate the Respondent's employment as alleged in the Administrative Complaint dated October 20, 1998.
Findings Of Fact On August 14, 1998, Respondent, a teacher employed by Petitioner, entered a plea of guilty to the charge of exploitation of an elderly person, which is a first degree felony pursuant to Section 825.103, Florida Statutes. At the same time, Respondent also entered a plea of guilty to the charge of petit theft over $100.00, which is a first degree misdemeanor. In entering these pleas, Respondent advised the court, pursuant to Rule 3.172(d), Florida Rules of Criminal Procedure, that she believed the pleas were in her best interest and that she was maintaining her innocence to the charges. The court withheld adjudication of guilt as to the charge of exploitation of an elderly person, adjudicated her guilty of petit theft, sentenced her to one day of time served, placed her on probation for 20 years, and required that she pay restitution to the Estate of Lillie Keller in the amount of $52,000.00. 1/ By letter dated October 21, 1997, Petitioner reassigned Respondent to a position with no direct contact with children pending the outcome of the criminal charges. Following an investigation, the superintendent of schools recommended to the school board that Respondent's employment be suspended without pay and terminated. On October 7, 1998, the school board voted to adopt that recommendation. The recommendation and the subsequent vote to adopt the recommendation were based on Respondent's plea of guilty to the charge of exploitation of an elderly person. Petitioner followed its procedural rules in investigating this matter and in voting to terminate Respondent's employment. As of October 7, 1998, Respondent held a professional services contract and had been employed by Petitioner for approximately 13 years as a teacher. Section 231.02(1), Florida Statutes, requires school board employees to be of good moral character. Respondent, as a teacher, is required by Section 231.02(2), Florida Statutes, to be fingerprinted and screened by the Florida Department of Law Enforcement. Section 435.03(2), Florida Statutes, provides, in pertinent part, as follows: (2) Any person for whom employment screening is required by statute must not have been found guilty of, regardless of adjudication, or entered a plea of nolo contendere or guilty to, any offense prohibited under any of the following provisions of the Florida Statutes or under any similar statute of another jurisdiction: * * * (v) Section 825.103, relating to exploitation of an elderly person or disabled adult, if the offense was a felony. Petitioner's Rule 3.12, pertaining to criminal background checks of current and prospective employees, has been duly enacted and provides, in pertinent part, as follows: Definitions: For the purposes of this policy: * * * b. "Conviction" means a determination of guilt that is the result of a plea or a trial regardless of whether adjudication is withheld. * * * 3. A prospective or current employee may be disqualified or may be terminated from continued employment if the prospective or current employee has been convicted of a crime classified as a felony or first degree misdemeanor directly related to the position of employment sought or convicted of a crime involving moral turpitude or any of the offenses enumerated in Chapter 435, Florida Statutes. Section M of the collective bargaining agreement between the Petitioner and the Palm Beach County Classroom Teachers' Association provides for progressive discipline of covered employees such as Respondent. Section M provides, in pertinent part, as follows: Without the consent of the employee and the Association, disciplinary action may not be taken against an employee except for just cause, and this must be substantiated by clear and convincing evidence which supports the recommended disciplinary action. * * * 7. Except in cases which clearly constitute a real and immediate danger to the District or the actions/inactions of the employee constitute such clearly flagrant and purposeful violations of reasonable school rules and regulations, progressive discipline shall be administered as follows: Verbal Reprimand With a Written Notation. . . . Written Reprimand. . . . Suspension Without Pay. A suspension without pay may be issued to an employee when appropriate, in keeping with the provisions of this Section, including just cause and applicable law. ... Dismissal. An employee may be dismissed (employment contract terminated or non-renewed) when appropriate in keeping with provisions of this Section, including just cause and applicable law. Section 435.06(2), Florida Statutes, requires an employing agency, such as the Petitioner, to take the following action when an employee has failed to meet the requirements of Section 435.03(2), Florida Statutes: The employer must either terminate the employment of any of its personnel found to be in noncompliance with the minimum standards for good moral character contained in this section or place the employee in a position for which background screening is not required unless the employee is granted an exemption from disqualification pursuant to s. 435.07. 2/
Recommendation Based on the foregoing Findings of Fact and Conclusions of Law, it is RECOMMENDED that Petitioner enter a final order that terminates Respondent's employment based on the findings of fact and conclusions of law contained herein. Findings Of Fact At all times material to this proceeding, Respondent was certified as a correctional officer, having been issued Correctional Certificate Number 151337. Respondent was employed by the Department of Corrections, Lake City Service Center from October 1, 2000 until October 18, 2001. On or about January 27, 2001, Respondent was sitting in the right front passenger seat of his black Ford Mustang in the parking lot of the Ponce de Leon Mall (the Mall) in St. Augustine, Florida. Another man was also sitting in the vehicle. A third man who had been a passenger of the vehicle was walking toward the vehicle from the Mall. Deputy Joey Romer of the St. Johns County Sheriff's Office and Detective Ronald S. Faircloth were working in an off-duty status as security for the Mall. Deputy Romer and his K-9 dog, Justice, approached Respondent's vehicle in the mall parking lot. Justice is trained in narcotics detection. Justice "alerted" to the free air odor of Respondent and to one of the other occupants of the vehicle. That is, Justice "did the full response of sitting down, which is an indication of a drug odor." Justice also alerted to the lower seam of the passenger door where Mr. Buckley had been sitting. Deputy Romer then searched the vehicle and found two small packets of what appeared to be marijuana in a Checker's food bag on the front passenger floorboard. Deputy Romer did not do a field test of the suspect marijuana. Based upon his experience, Deputy Romer concluded that the suspect substance was marijuana. Detective Faircloth initially stayed back from the vehicle for officer safety reasons. He saw Deputy Romer place Respondent under arrest. Detective Faircloth then approached the vehicle. Respondent admitted to Deputy Romer that the suspect substance was marijuana and that it was his. In the presence of both Deputy Romer and Detective Faircloth, Respondent identified himself as a corrections officer. In the presence of both Deputy Romer and Detective Faircloth, Respondent asked if there was any way they could just dump out the marijuana because it would affect his job. Deputy Romer then arrested Respondent. Respondent was charged with possession of less than 20 grams of marijuana, a misdemeanor. On January 28, 2001, Respondent filed an incident report indicating that he was arrested on January 27, 2001, for possession of less than 20 grams of marijuana.
Recommendation Based upon the foregoing Findings of Fact and Conclusions of Law set forth herein, it is RECOMMENDED: That the Criminal Justice Standards Commission enter a final order revoking the corrections certificate of Respondent, James C. The Issue The central issue in this case is whether there is a disputed issue of material fact to be resolved by an administrative hearing.
Findings Of Fact On October 30, 1991, the Department of Professional Regulation, Division of Real Estate, issued an administrative complaint against Marilyn Mirus, the Petitioner herein. [Administrative complaint attached to motion to relinquish jurisdiction as Exhibit A, not disputed by Petitioner] The administrative complaint alleged three violations of Chapter 475, Florida Statutes: having been convicted or found guilty, regardless of adjudication, of a crime in violation of Section 475.25(1)(f), Florida Statutes; having been found guilty of a course of conduct which shows dishonesty in violation of Section 475.25(1)(o), Florida Statutes; and having failed to inform the FREC of having pled nolo contendere or having been convicted of a felony within thirty days of such conduct in violation of Section 475.25(1)(p), Florida Statutes. [Exhibit A to the motion, not disputed by Petitioner] The allegations arose as a result of a criminal case in Broward County, Florida (Case no. 91-4894CF) wherein the Petitioner was charged with 31 counts of grand theft. In connection with those charges, the Petitioner pled nolo contendere and received a five year probation. Additionally, the court withheld adjudication of guilt for all counts. [Exhibit A to the motion, not disputed by Petitioner] As an additional condition of the sentence, Petitioner was required to make restitution in the amount of $69,834.50 to the alleged victim. [Exhibit A to the motion, not disputed by Petitioner] To resolve the charges of the administrative complaint, Petitioner entered into a stipulation attached to the motion to relinquish jurisdiction as Exhibit B. [Not disputed by Petitioner] The stipulation provided, in pertinent part: Respondent [Petitioner herein] neither admits nor denies all the allegations of essential fact contained in the Administrative Complaint. Respondent admits that the allegations of fact contained in the Administrative Complaint, if true, support a finding of a violation of the Real Estate Practice Act. There is currently pending in the Florida Fourth District Court of Appeal an appeal (hereafter, "the Appeal") of the Order dated March 2, 1992 (hereafter, "the Order"), denying the Respondent's Motion to Vacate and Set Aside Plea in Case No. 91-4894, Division FM, in the Circuit Court of the Seventeenth Judicial Circuit in and for Broward County, Florida. STIPULATED DISPOSITION * * * 8. The Respondent's license shall be suspended beginning on the filing date of the Final Order approving this Stipulation. Thereafter, the suspension shall remain in effect during the pendency of the Appeal. Immediately upon the conclusion of the Appeal, the Respondent's license shall be automatically and permanently revoked unless the Order is reversed as the direct and immediate result of the Appeal. In the event of such reversal, the suspension shall be lifted. * * * 13. The Respondent expressly waives all notice requirements and right to seek judicial review of or to otherwise challenge or contest the validity and enforcement of this Stipulation and resulting Final Order of the Commission adopting and incorporating this Stipulation. [Emphasis added.] A final order accepting the stipulation entered into by the parties was adopted on May 19, 1992. [Attached to the motion to relinquish jurisdiction as Exhibit C, not disputed by Petitioner] The District Court of Appeal rendered a decision on April 21, 1993, which denied Petitioner's request to set aside the nolo contendere plea. Her requests for a rehearing on that decision were also denied. [Attached to the motion to relinquish jurisdiction as Exhibits D and E, not disputed by Petitioner] Petitioner maintains [Response to order issued by Hearing Officer on November 29, 1995] she should be able to challenge the denial of licensure because of the following disputed matters: Did Petitioner commit the crimes of which she was accused, and to which she plead nolo contendere? The Courts have held that when there is a plea of nolo contendere filed, it raises the presumption that a crime had been [sic] convicted. However, the Courts have held that the Licensee has the opportunity to rebut this presumption and assert his or her innocence of the underlying criminal charges together with what the reasons and circumstances were to show why the plea of nolo contendere was raised. See Ayala v. Department of Professional Regulations, 478 So.2d 116 (1st DCA Fla. 1985) and Son v. Florida Department of Professional Regulation, Division of Real Estate, 608 So.2d 75 (3rd DCA Fla. 1992). Was the Petitioner advised as to what the effect of her plea of nolo contendere would have as the same relates to the revocation of her license by the Department of Business and Professional Regulations? What was the effect of revocation of one's Real Estate License on April 7, 1992, at the time the stipulation was entered into by Petitioner? Has the effect of a revocation on a license changed from April 7, 1992 [to] today, if so, was her (sic) advise proper to enter into the Stipulation had she known what the law was today as it relates to the law of 1992? (It wasn't until October 1, 1992 that revocation became permanent. Prior to that date the laws of Florida were silent as to the term of a revocation. Section 455.227(4) F.S. 1992.) Was the adjudication withheld and was the file sealed as it relates to the criminal charges which were the subject of the original complaint against Marilyn Mirus? Is the Petitioner now held accountable for a crime that under the Florida law for all intents and purposes she did not commit nor was she even charged with such a crime? Petitioner has not challenged the authenticity or accuracy of the documents attached to the motion to relinquish jurisdiction.
Recommendation Based on the foregoing, it is, hereby, RECOMMENDED: That Florida Real Estate Commission enter a final order dismissing the request for hearing filed by Petitioner. The Issue Whether Respondent committed the violation alleged in the Administrative Complaint issued against him and, if so, what penalty should be imposed.
Findings Of Fact Based on the evidence adduced at "formal hearing," and the record as a whole, including the parties' Joint Stipulation, the following findings of fact are made: Respondent is now, and has been since February 19, 1998, certified as a correctional officer in the State of Florida. He holds Correctional Certificate Number 178896. On February 19, 1982, Respondent was certified as a law enforcement officer in the State of Florida and issued Law Enforcement Certificate Number 34142, which has since expired. Respondent is now, and has been since shortly after receiving his bachelor of science degree in education from Slippery Rock University, certified as a teacher in the State of Florida. From the early 1980's until 1993, Respondent worked as a police officer for various law enforcement agencies in Florida. In 1985, Respondent was physically arrested and charged with battery in Pinellas County. He was acquitted of the charge following a jury trial. After the acquittal, at Respondent's request, records relating to the matter were ordered sealed. In the mid 1990's, Respondent worked for Wackenhut Corporation as a teacher at correctional facilities in Moore Haven and South Bay, Florida. While working for Wackenhut in South Bay, Respondent was asked to assist in the "start up" of a "work release center" in Broward County, Florida, that Wackenhut was going to operate for the Broward County Sheriff's Office. Pursuant to Wackenhut policy, Respondent had to "go through a correctional academy" before assuming his new duties. After graduating from the "correctional academy," Respondent relocated to Broward County and began his new assignment for Wackenhut. Respondent's primary tasks were to "draw[] up all the rules and regulations for the [soon to be opened] facility" and "interview[] people for jobs." Respondent was housed in a "temporary [Wackenhut] office" in Lauderdale-by-the-Sea, Florida, along with others involved in the effort to open the facility, including Richard Fortenberry, who was going to be the facility administrator. On September 26, 1997, Respondent was accused of stealing a "couple of packs of playing cards" from a retail establishment in Palm Beach County, Florida. The Palm Beach County Sheriff's Office deputy on the scene issued Respondent a notice to appear2 in lieu of physically arresting Respondent. As directed, Respondent subsequently appeared in the Criminal Division of Palm Beach County Court to respond (in Palm Beach County Court Case No. 97-024167 MM A04) to the retail theft accusation made against him. On November 17, 1997, Respondent signed a Deferred Prosecution Agreement in Palm Beach County Court Case No. 97- 024167 MM A04,3 which provided that, if Respondent complied with the[] "conditions [set forth in the agreement] during the [three-month] period of Deferred Prosecution, no criminal prosecution concerning this charge [of retail theft] [would] be instituted " On December 22, 1997, the Palm Beach County State Attorney's Office issued a Nolle Prosse in Palm Beach County Court Case No. 97-024167 MM A04. The Broward County "work release center" was scheduled to open in February of 1998. Respondent was to occupy a "lead supervisor" position at the facility when it opened. Before he was able to assume this position, however, Respondent needed to fill out an "extensive" application (even though he was already employed by Wackenhut) and pass a pre- employment review conducted by the Broward County Sheriff's Office. Respondent filled out the application, "to the best of [his] ability," in October of 1997. On the application, he mentioned the 1985 Pinellas County battery charge of which he was acquitted, but not the notice to appear that he had received the previous month.4 Deputy James Diefenbacher was the Broward County Sheriff's Office "contract manager" for the Broward County "work release center" project. In November of 1997, after Respondent had entered into his Deferred Prosecution Agreement in Palm Beach County Court Case No. 97-024167 MM A04, Mr. Fortenberry told Respondent that Deputy Diefenbacher needed from Respondent certain documents concerning the 1985 Pinellas County battery charge in order for Deputy Diefenbacher to complete his pre-employment review of Respondent's background. Respondent promptly furnished Deputy Diefenbacher the requested documents. On December 31, 1997, Deputy Diefenbacher "showed up" at Respondent's office in Lauderdale-by-the-Sea and told Respondent that he "needed to talk to [Respondent] real quick." It was New Year's Eve. The "handful of people," including Respondent, who were there, were finishing up there work for the day so the office could close early. After he and Respondent "looked over [Respondent's] application" together, Deputy Diefenbacher turned on a tape recorder, "swore [Respondent] in," presented Respondent with a document, and told Respondent, "I need you to sign this document here. It means that you don't have any other arrest history."5 The document, which was typed on Broward County Sheriff's Office letterhead, read as follows: I swear under oath that all information regarding my criminal history has been presented to the Broward Sheriff's Office. My criminal history consists of a charge of simple battery, of which I was found not guilty of all charges by the court. Not [sic] other criminal history exists. SWORN AND ATTESTED TO BY TIMOTHY J. MILLER ON THIS 31ST DAY OF DECEMBER NINETEEN HUNDRED NINETY SEVEN. Signed By: DEPUTY JAMES DIEFENBACHER OF THE BROWARD SHERIFF'S OFFICE Signed CCN# Respondent signed the document without reading it. Respondent took Deputy Diefenbacher at his word that, by signing the document, Respondent was attesting that he had no other arrests other than his 1985 arrest in Pinellas County for battery. Respondent did not intend to deceive anyone in signing the document. He believed that the information contained in the document (as explained to him by Deputy Diefenbacher) was true.6 He did not consider his having been given a notice to appear (on September 26, 1997, in Palm Beach County) to have constituted an arrest.7 Nonetheless, "a couple [of] years later," Petitioner was charged with and tried for perjury in connection with his signing the document; however, he was acquitted of the charge.8
Recommendation Based upon the foregoing Findings of Fact and Conclusions of Law, it is hereby RECOMMENDED that the Criminal Justice Standards and Training Commission issue a Final Order dismissing the Administrative Complaint issued against Respondent in the instant case. The Issue Whether or not the Respondent, Anita J. Shear, R.N., is entitled to have her terminated license No. 27650-2 reinstated, in view of the alleged allegations that the Respondent has been found guilty of the conviction of a felony in the course of the State of Florida. (See Section 464.151(1)(b) and Section 464.21(1) Florida Statutes.)
Findings Of Fact This cause comes on for consideration based upon the Administrative Complaint presented by the Petitioner, Florida State Board of Nursing, against the Respondent, Anita J. Shear, R.N. The case is presented as Docket No. FSBN 78-70. The Administrative Complaint seeks to deny the re-registration of the terminated license of Anita J. Shear, who held license No. 27650-2 (terminated). The alleged grounds for the denial of the re-registration are based upon the alleged plea of guilty to the felony charges of unlawfully obtaining services, goods, wares or other things of value by means of a worthless check or draft in the amount of $187.00 in a case in the Circuit Court in and for Dade County, Florida, Case No. 77-2285. The allegation is that the Respondent entered the plea on or about March 14, 1978, and was adjudicated guilty of the felony by the Court and sentenced to serve a term of one year in jail upon certain terms and conditions. There is an additional ground stated in the Administrative Complaint for denying the re-registration, which is to the effect that the Respondent on or about March 14, 1978, entered pleas of guilty to the felony charges of uttering a forged instrument (three counts); grand larceny (three counts) and intentionally receiving, retaining, disposing or aiding in the concealment of stolen property, well knowing the same to be stolen (three counts). This series of pleas were allegedly presented in the Circuit Court in and for Dade County, Florida, in Case No. 77-2304, for which the Respondent was allegedly adjudicated guilty of all those aforementioned felonies in Case No. 77-2304. At a time prior to March 31, 1978, the Respondent, Anita J. Shear, R.N., was a holder of license No. 27650-2, held with the Florida State Board of Nursing. That license was to practice as a Registered Nurse in the State of Florida. The Respondent, prior to March 31, 1978, had failed to timely renew her license and had terminated according to the terms and conditions of Section 404.151(1)(b), Florida Statutes. The timely renewal spoken of meant that the Respondent had failed to renew her license before the expiration date of the current license under which she was allowed to practice her profession in the State of Florida. On March 31, 1978, the petitioner received an application for reinstatement of the Respondent's license, filed by the Respondent. The Petitioner failed to re-register the Respondent for reasons as set forth in the summarization of the Administrative Complaint. The Respondent was advised of this denial of re-registration on May 1, 1978. This in turn led to the consideration of the case by formal hearing with the State of Florida, Division of Administrative Hearings. The facts revealed that the Respondent, Anita J. Shear, in the Circuit Court in and for Dade County, Florida, in Case No. 77- 2285, entered a plea of guilty to unlawfully obtaining services, goods, wares or other things of value by means of a worthless check or draft in the amount of $187.00, for which she was adjudged guilty and sentenced to a term of one year in the Dade County Jail with the provision that after nine months served, the remaining three months should be stayed and withheld and the Respondent be placed on probation for a period of two years, subject to the terms and conditions of the Court. This plea and sentence were entered on March 14, 1978. This offense for which the Respondent entered her plea is a felony under the laws of the State of Florida, in particular, Section 832.05(3), Florida Statutes. On March 14, 1978, in the Circuit Court in and for Dade County, Florida, in Case No. 77-2304, the Respondent entered a plea of guilty to uttering a forged instrument (three counts), felonies under the provisions of Section 831.02, Florida Statutes; grand larceny (three counts), felonies under the provisions of Section 812.021, Florida Statutes, and intentionally receiving, retaining, disposing or aiding in the concealment of stolen property, well knowing the same to be stolen (three counts). The latter plea was made in accordance with the provisions of Section 812.031, Florida Statutes, but it is unclear from the evidence presented whether or not those pleas were to the misdemeanor offenses of receiving stolen property or to the felony offenses. The Respondent was adjudicated guilty of those offenses found in Case No. 77- 2304 and was given a period of probation of two and one-half years beginning at the expiration of the sentence in Case No. 77-2285. A statement of Court action in cases Nos. 77-2285 and 77-2304 may he found in the Petitioner's Composite Exhibit No. 1 admitted into evidence. After discovering the existence of the felony conviction stated above, placed against the Respondent, the Petitioner has denied the Respondent's application for re-registration. The Petitioner may deny the license to the Respondent in view of the felony convictions under the authority established in Section 464.21, Florida Statutes, which states: "464.21 Disciplinary proceedings.-- GROUNDS FOR DISCIPLINE.--The board shall have the authority to deny a license to any applicant or discipline the holder of a license or any other person temporarily authorized by the board to practice nursing in the state whose default has been entered or who has been heard and found guilty by the hoard of: * * * "Conviction of a felony in the courts of this state . . ." Therefore, the Petitioner was correct in denying the Respondent's application for re-registration as a Registered Nurse.
Recommendation It is recommended that the Respondent, Anita J. Shear, R.N., have her application to re-register as a licensed Registered Nurse in the State of Florida, DENIED.
