Landlord/Tenant

I moved to Arizona from South Dakota in Dec, of 2005 to be with my sister during cancer treatment. At that time I informed my landlord that I would not be able to pay my lot rent on my trailer for a few moths, but that when I started work I would make double payments, to which he agreed. Over the last year, I have been sending payments when I was able, which he accepted. I recently in the last Month sent him $600. I have since eceived notice that he will not accept anymore payment and I taking possession of my home for past due rent. Can he do this after having agreed to and accepted payments although not consistently?

Your question was sent to me, an Arizona lawyer, under the heading of "Mediation" law. The proper category is landlord-tenant law of South Dakota. You need to speak with an attorney in that state, and show him any written contract or letters that pertain to your case. Act quickly.
