Youth cell phone use in school

I am wondering if it is legal to search children for a cell phone, and after three warnings, none of which were given to parents, the child is expelled and incarcerated for 30 days and then the school retains the confiscated phone. The child is also not allowed to defend themselves against charges or allowed at any agency hearings.

It would not be legal to incarcerate a child for 30 days without a hearing unless there was some other facts, such as the child was on probation. The child would be allowed - indeed required - at hearings.
