I came to the US to do an internship which was 3 days ago terminated due to coronavirus. I have now 30 days to leave. Can I file to change my status to tourist visa? What if that takes longer than the 30 days, would I be here legally? What if I need to leave before they approve it?
Should I behave like my visa change is approved after filling?
I just really do not want to have nay problems and I don't want to risk being here illegally.
You cannot change your status if you are subject to the 2-year residency requirement, unless you seek a waiver.
Generally, one must be in status to change status. But, hurry you might.
First, are you subject to the two year foreign residency requirement? If so, you cannot change status to anything unless you stay home for two years or get a waiver.
Second, if are not subject to, you may be able to change status but they won’t make a decision until after the six months you request already expires.
