I've been suffering for seven years from a condition that causes excruciating pelvic pain, lower back pain, and fatigue for up to 6 days at a time and is cyclical related to reproductive health issues. The pain affects my ability to walk, stand, sit, and causes urinary urgency and pain if I hold my urine during this week of pain. I get very little sleep for at least three days during this week due to sleep interruption from the pain, which affects my alertness on the job. In a one year period I have had eight occurrences due to this pain. My employer suggested fmla so I reached out to Sedgwick and applied for fmla. I have seen three Doctors and have had three ultrasounds in the past seven months to try and identify the cause of my pain. I also have diagnostic surgery set up for Jan 11, 2019 to look for endometriosis, which my Doctor suspects may be the cause of my pain. The costs are a great financial burden but I've advised my manager I'm actively seeking help for this medical condition, however three to four times she has threatened severe future disciplinary action. I feel so depressed and stressed. What are my rights?
It sounds as though you may have claims under both the Americans With Disabilities Act ("ADA"), AND the Family and Medical Leave Act ("FMLA"). You need to talk to an employment law attorney as soon as possible.
