My child requires medication (1-2x wkly) for a long-standing health condition. I have provided the childcare facility w/ a doctor's note describing the need for medication. The medication comes in powder form & must be mixed into liquid. My plan was to pre-mix the medication w/juice in a cup w/a lid & the facility would provide the cup at lunch. The facility stated they wouldn't administer the medication bc it would put the other children at risk were another child to drink the medication; the facility also stated if they allowed medication mixed into the cup they would have to provide my child special attn to prevent another child from drinking the juice & medication & they were not equipped to provide such special attn when the med would need to be given. Can the facility refuse?If it matters, my child had been taking a doctor Rx medication and an OTC medication for her health condition. Currently, her symptoms are such that she is only using the OTC medication. Yesterday, the facility placed notices on all the classroom doors stating that medications, probiotics or other OTC supplements are not to be mixed into children's cups. I assume this notice was directed at me despite my having been clear with facility's director that I would refrain until I sought legal advice. The childcare facility is not associated with a religious organization.
Probably. You can call the Texas Department of Family Protective Services. They would know if there is a specific regulation about this.
There is also a potential ADA issue here.
For me the bottom line is that if the facility does not want the responsibility, I would likely search for another facility.
This does not seem reasonable if they have concerns about poisoning other children.
