I have been on TN Visa for 3 years and I just got married to a US citizen on 2/8/2020 and we were just getting our paper work together to file for residency for me and now with the COVID-19 situation I am worried that I might be laid off. If I am laid off then my understanding is that I have a 60 day grace period to find employment or get my affairs in order. I have not yet applied for the AOS (form I-130 & I-485 etc.) and since I got married, I will not be able to leave the country to get a new TN Visa or to leave and come back with my B-2 Visa. So I just wanted advise on whether it would be ok to file for residency while under the 60 day grace period.
Yes, you may file for adjustment of status now.
Yes, you could file for adjustment of status during the 60 day grace period, based on marriage to a U.S. citizen. You could also file after the sixty day grace period.
A TN married to a US citizen may file for Residency under the 60 day grace period of TN Visa.
You may file for adjustment of status asap.
