Can a commissioned officer be charged with article 134 (adultery with a military members spouse) after retirement if the offense took place while the officer was active duty?

Under certain circumstances, an officer can be recalled to active duty to face criminal charges which allegedly occurred while on active duty. However, these usually occur for far more serious offenses than an allegation of adultery. Before you make any statements or agree/disagree with any proposed actions, make sure you consult with an attorney familiar with military law. This is an unusual occurrence and you and your attorney will need to closely monitor their actions.
