You probably have a case against the building owner/operator but it’s much different than a workers comp case and it can be different than your typical “slip and fall” case since you were on the job. Best advise is to consult with an attorney who understands each type of case and whom can ask the right questions about the entire set of facts and circumstances so you can know your options completely.

You absolutely may file a claim but the person or party against whom that claim is filed will depend on the specific circumstances of your injury. If your employer was the negligent party which led to your fall, you may file a workers' compensation claim but you will not be able to sue your employer in tort. However, if the negligent party was someone other than your employer but you nevertheless suffered the injury while within the scope of your employment, you may file a workers' compensation claim against your employer AND a tort suit against against the negligent party.
