If you get a dui in a state you don't live in do you have to stay in that state until your trial date or can you go home

As a general rule, the first thing that you should do is to closely examine the recognizance, or release papers. These papers, which are sort of a court order, dictate the conditions of release. Typical conditions may include the inability to leave the state, the requirement to keep or secure employment, or refrain from the use of alcohol and non-prescribed drugs. In short: the answer will likely be in the paperwork

He needs to check his release conditions with his lawyer. Since he has an out of state address, he likely had to sign a release form which likely states whether he can leave the state or not. If he has a condition that states he cannot leave, he can ask his lawyer to bring a motion to change that condition.
