My son has had 3 duis in Fl and had his license revoked about 10 years ago.

It depends. If the State can prove he was in actual control of a moving vehicle with an unlawful blood alcohol concentration he could be prosecuted and convicted. Time of last being in control is an issue. THey would have to show an unlawful BAC within 3 hours of when the driving ended. Much will depend upon what evidence your son gave the police, admission of driving, indication of drinking prior to driving etc. I would recommend hiring him a lawyer that is familiar with that particular jurisdiction.

It is hard to say without knowing more information about the arrest. Regardless, he needs an attorney ASAP.
