My son was arrested in Hennepin County for DUI 4th degree. He blew a 0.00 and was taken to HCMC to have blood drawn. He is on medications prescribed by a physician but that was it. What will happen when the test results come back negative for alcohol and only the prescription drugs are in his system? Do they drop the charge or drop it to a lesser charge such as inattentive driving?

In addition to Mr. Beaulier's very comprehensive and well stated answer, I would simply like to add that taking prescription medication in the manner that it was prescribed can be a complete defense to a DWI charge.
