I am the primary parent, my ex has responsibility for child support and health insurance. My current husband, their step dad can provide the insurance for free, so we decided with the ex on an agreed amount for him to pay us and we hold the insurance

Is this legal? Technically we are not using it towards a premium.

Yes, this is legal.

It wouldn't hurt if you sent Dad a reminder/agreement like this (email is fine):

"I just wanted to make sure we're on the same page: You are going to pay us $78 per month, and my new husband will provide insurance for the children through his employer."

Send it, and keep a copy. With a date on it.
