if there is no custody of my kids, and i get permission from there mother to take them out of state, can i be arrested if i don't take them back to their mother?

Can i fill for temporary custody in the new state or does it have to be done in the state my kids live. I live in Nebraska, they reside in Louisiana

Is your name on the birth certificates? If not, do you have a court order stating you are the father? If not, have you signed an acknowledgement that you are the father? No matter what the mother says, if you do not return the children, you could be arrested. I do not know how old these children are, but the fact that you have never gone to court to be legally recognized as the children's father, says something. Do not try an end run. File in Louisiana and have your rights declared by the court.
