independent contractor injured

I am a general contractor. I hired a company to do painting. The sub-contractor pays his employee. Can I be held responsible for workers comp. if the employee is injured on the job? Can I get a blanket workers comp. policy to cover me?

Re: independent contractor injured

I do not know if there is anything that would be a blanket WC policy. Either the person is your employee or he is not [with a few rare exceptions]. Talk to your comp. carrier but it seems to me that someone controlled and paid by the sub-contractor, a worker you can not fire nor raise their pay, is clearly not your employee and could sue you if he was injured at work.
