Superior Court Is Not Paying Back Jury Fee

I am a Plaintiff in pro per. I settled my case with the Defendant in a civil lawsuit I had filed with San Francisco Superior Court in January 2009. I waited until end of March 09 to get reimbursed the $150.00 jury fee I had paid. The reason for my wait was when I paid the jury fee, the clerk of the court told me that I will get my money back if my case does not go to trial. I visited the court end of March and asked for my jury fee. I was told that I needed to fill out a request form to get my money back. I did so and they told me that I should get my money back in 3 � 4 weeks. Since I never got my money back, I contacted the court again. This time, I was told that since I did not fill out the request form to get the jury fee back within one month after the date of settlement of my case, they had returned the money to state and I will not get my money back.

Do I have any options to get my money back such as filling a claim in Small Claims Court?

You should obtain and review Code of Civil Procedure section 631.3 which requires the forfeiture of deposits of jury fees to the General Fund under certain circumstances. It very well may be that your deposit is forfeited.
