Allegation of Sexual Assault when accused was a minor and alleged victim was 18. Is the allegation still valid?

A statute of limitation is the maximum time in which a matter can be brought to court or it cannot be pursued. Tolling means suspending time. While a victim is a minor, under 18, the statute of limitations is tolled. But in your question, you say the accused sexual harasser was under 18. In that case the statute for the Adult Victim is still running and the statute is 2 years or even 3 years, depending on the circumstances.

The victim of the harassment may have a problem because the harasser is a minor, and it could be possible for the tables to be turned and the victim accused of statutory rape or even delinquency of a minor.

These matters need to be discussed fully in private with an attorney.

don't discuss sensitive info like this on a public forum.

make an appt with a criminal lawyer in your area to check the court computer to learn of any filing....and status with DA..........though you may not want to wake a sleeping dog.

anyone can sue for anything at any time within the Statute of Limitations. the issue is whether one would win.

without more info that is hard to say.
