I live in PA. I was fired fro Job A on 2/7/20 for willful misconduct but worked there for 6 years. I persistently job hunted and finally came along job B where I was given a signed “formal offer of employment that details the final and complete agreement between you and “company name”. The letter also stated “your anticipated date of employment is March 23”.
Today on March 20, I receive an email saying “we are withdrawing the offer of employment letter signed March 10..... once we have a new start date decided we will send you an updated offer letter.... hopefully these things with Coronavirus calm down soon and we can start sometime in April...”
My question is: can I file for unemployment now? This seems to be specific to Coronavirus situation so I can’t find any info online to help me understand this since it’s kind of an unprecedented situation. In regards to Job A that I was fired from, I believe unemployment would be denied from them as an employer but would I just try to file a claim using this new Job B information?
You say you were fired for "willful misconduct." Who told you it was willful. All the employer has to do is put down "willful misconduct" and the UC will deny it. Willful misconduct is well defined by the UC commission on their webpage. You should file for unemployment NOW, and if you already have and been denied, you should file asking for an APPEAL NOW!!! There is a strict time limit on filing an appeal. Talk with one of us here at avvo.com about exactly what willful misconduct is. They have to Prove you did something willful. Now if you stole something and they have you on tape, that is willful. But do give one of us a call and tell us the entire situation. You may well be entitled to UC benefits. Also the finding of not-eligible is turned over a lot.
