The private daycare/preschool, our kids go to, is closing due to the coronavirus. There are no cases of any student or teacher being sick. It's a preschool that has less than 5 teachers work each day and only 28 students per day. They are not refunding us for the time of closure and are expecting us to pay for next month although they will be closed. They offered to merely teach over zoom, but my kids are only 2 and 4 yrs old they don't get to play or be on any computer or devices, plus other families have autistic children and they won't sit in front of a screen at all. Can they legally bill us if it is not in our contract?
When considering an action regarding breach of contract, the first thing to do is read the contract.
Your contract will dictate the refund and tuition refunds. If the agreement is silent, then service not provided should not be paid. However if you want to maintain the relationship you might want to offer a compromise for termination. That way in the future you can re-enroll when you need the service again.
