I was driving at work in my work vehicle on 10/7/08, and was t-boned by a woman who ran a stop sign. I was brought to the hospital, and had the usual xrays. Nothing was found, and I was released. Upon waking up I could not move my back or knee. I was referred to an Orthapedic Dr. and he felt that I needed an MRI of my back for one, and that my knee was just bruised. I fought with Workers Comp for three onths for this MRI. In the meantime, WC sent me for physical therapy for three months. After obtaining legal council, WC approved the MRI. The Dr. found a compressed and bulged L4-L5 and a compressed L5-S1. I was sent by my Ortho Dr. to a neurosurgeon. He had me go for cortizone shots for three months. After the cortizone, he suggested a double lumbar discectomy. Workers comp of course denied that, and wanted me to go for a IME. I agreed and I poriceeded to wait 4 MONTHS for them to MAKe an appt for that!!! I finally had to call an threaten them with a hearing at the WC Commision for them to make this appt. Upon arriving to the IME I noticed that the WC Dr. worked out of the same office as MY DOCTOR!!! They are collegues! He of course said no to surgery, and stated that he wanted me to go for an EMG study??!! I said ok, and he told me to go back to work setintary duty. So I returned to work for one day, and my boss had me lifting 40-50 pound boxes for 9 hours, and I injured myself even worse! I went to the hospital and they gave me scripts and kept me out of work until seen by my Neuro. I saw my Neuro and he suggested a follow-up MRI to see the damage. I am now waiting for that to be approved�.. I feel that my lawyer might not be fighting enough for me. I have told him the following situation and he says either he will call me back or that we have to wait! In the meantime, my wife is in Nursing school and cannot work. WC doesn�t pay me crap, and I have to pay for my medical insurance fully! We are so far behind in bills, we are going to lose our house and her car if we don�t get some compensation soon! Am I entitled to any money right now from either the lady who hit me or WC to be able to live??? Sorry for the long explanation, but I wanted to get it all in. Any help would be greatly appreciated!

If your employer does not have work that you can do, your lawyer should be advising you to do work searches to continue getting paid workers compensation benefits. One year out from the accident date may be long enough to have the case against the woman who hit you settled depending on how much insurance she has.
