There has already been much written on this issue. A lawyer would first look at the language of the contract.

Act of God? Likely not. Force Majeure maybe. None can know what will happen in your family members case without reading the contract they signed---the entire contract.

An Act of God” provisions are clauses can excuse one of the parties to a contract from performing their side of the bargain – absolving them of financial responsibility or extending deadlines without a penalty. Therefore you will need to retain an experienced PA civil litigation attorney to resolve this matter. THIS IS NOT LEGAL ADVICE! YOU NEED TO SPEAK TO AN ATTORNEY WHO IS LICENSED IN YOUR STATE FOR LEGAL ADVICE. This is merely suggestions for you to think about in discussing your situation with the local attorney.
