My husband has a civil case pending in (california) superior civil court district three adminstrative appells court. His attorney filed with the courts in december 2010 ,case has been fully briefed two years this march. The courts sent a notice back in october 2013 asking if he wanted oral argument ,he waved oral argument. It has been 5months since oral agrument was waved and he still has not had a decission from the courts. What could be taking so long. Thank you for your time

Besides your attorney you can contact the appeals court clerk if some action has delayed the decision. Normally the court has ninety days from submission to issue a decision. The submission would have occurred on waiver of argument. However, the consequences from failure to release a decision only affects the courts pay not the results. Probability is that the court has taken some action such as resubmitting the case which restarts the ninety day period. You may not have received notice. Some times attorneys do not keep up with intervening court action. Check with court of appeals clerk to determine status. Good luck!
