Hi, I am based out of Fort Lauderdale, FL and my lease is set to expire mid april 2020. With the covid-19 outbreak, I was wondering what would happen in my situation where we might possibly be under mandatory quarantine or even martial law? Would I still be forced to move out? Or would they make us stay in place due to the situation? What tenant rights do I have in this scenario as a renter?
I was planning to move out originally, but with the uncertainty of the economy and this country I wouldn't want to move to a new apartment with prices super inflated at the moment. Can anyone shine some light into this subject please?
Thank you so much for your advice in advance!
As a practical matter, given the difficulty you may have in finding a new apartment, discuss extending your lease for a short period or review your lease for any terms of what happens when it expires. Generally, the tenancy becomes a month to month at the expiration of the lease.
You cannot become the landlord's adopted child. The landlord can evict you and ruin your credit. The eviction might not be immediately enforced but you will be responsible for any unpaid rent and will be forced to ultimately find a new apartment with damaged credit.
You are asking excellent questions. But, look, none of us has lived or practiced law through something like this. Every one is learning, on a day-by-day basis.. I wish I could be more helpful. Martial law? Not impossible. It boggles the mind, and might not be "legal", but at this point, nothing can be ruled out. No one in their right mind is going to argue with a National Guardsman or Marine with an automatic weapon in the middle of the street.
If it is any consolation, landlords are also sweating out the uncertainty. If there is a 24-hour curfew no process servers are going to be out serving process.
Good luck getting through this process/difficult time.
