I am currently here in the US under B1 Visa, my visa is expiring this coming April 21, 2020. I got married last Feb 2020 and I am planning to do an H4 visa stamp when I go home to my country. Unfortunately, I moved my flight to April 16, 2020, instead of March 26 due to lockdown in my home country up to April 14. Now, LA is in lockdown situation also until April 19, With this situation, I am worried that the pandemic will not end anytime soon, and it can affect the international flights. In my situation, what should I do in case I can’t go outside the US before my visa expires on April 21?
If I do COS B1 to H4 to legalize my stay, I still don’t have the Marriage certificate with us to file COS, I think it will be delayed due to the COVID-19. It’s been a month since we got married and I Haven’t received my marriage certificate.
If I apply for B1 extension, isn’t it too late already?
You can apply for a change of status to H-4.
Are you certain that you are in the US on B-1 and not B-2?
Go to www.cbp.gov/i94 to verify.
Talk to an attorney, you probably can file a change-of-status without leaving the US.
PS You should double-check your facts ... LAX is not on full lock-down.
In case the visitor married to an H1 can't go outside the US before the visa expires on April 21 should file a change of status to H4.
