I pay child support and was the only wage earner as my ex-wife went into a job re-training program after she was laid off last year (she completes it in Aug). My position at work was recently terminated due to organizational restructuring. I know I need to re-open the case and petition for a reduction in support. I have medical benefits covered for at least 3 more months. I have already gone to unemployment office and opened my claim, etc and received 2 months severance. It will be 2 -3 weeks before I see any severance or unemployment tough and my child support payment is due soon? What do I need to do short and long term to protect my custody (50/50 physical and decision) and not get too far behind in support and need to reduce it until I find a new job?

The first thing to do is notify the court and request an adjustment in child support due to your employment situation. The court can only act to adjust your support from the date you file with the court.

If possible, discuss the situation with your ex-wife. Let her know that you don't have the money to pay it all and will do the best you can to keep paying.

Parenting rights and responsiblities should NOT be an issue. The payment of child support should NOT be linked to your time with your child or children. As always, the court has the final say on what should be done given your personal situation.
