Original Contract

I am being sued by a debt collector and I am wondering if there is a staute that requires the plaintiff to produce the original contact you signed regarding the debt. How can they prove their case if they don't have document saying you owe the money?

Re: Original Contract

In Virginia, under the Fair Debt Collection Practices Act, upon your request a debt collector must make certain disclosures/notices to you, including the amount of the debt, the original creditor, a statement regarding how you might contest the debt and a statement regarding how you can request written verification of the debt.
