Will language
In a Will, in the beneficiary designation, the language reads to: my children, and their heirs, does that mean the wife/husband of the children if they are deceased, and does it reach down to the children of the deceased? The children were never adopted and do not have the same last name.

Generally a will will be written so that upon the death of a child prior to the testator that the share of the deceased child will go to his children if he or she has any and if not to the Testator's other surviving children.
