I own a business and Plaintiff is a popular individual who is making an ADA claim. I don't want to litigate the case since I know I will eventually have to pay the statutory fee and reasonable attorney costs. Well, how much is a reasonable amount of settlement for a case like this?
$4000 per occurance, meaning per visit. So if there were 3 different ADA violations but the plaintiff only visited once, $4000 plus reasonable attorneys fees in California is the general rule. I would recommend at least consulting with an attorney prior to attempting to negotiate a settlement since there are details that may make a difference. An attorney will have an advantage in settlement negotiations, so you may want to consider at least hiring an attorney to represent you in negotiations.
