In Georgia, It's been almost a year since the court system refiled a dismissed case against me. Initial misdemeanor charges against me were dismissed after waitng almost two years because the prosecution was still not prepared. Charges were re-filed against me the day after they were dismissed. Its been a year now with no extenuating circumstances or reasons why I am still waiting to go to court. Is there something I can file to dismiss my case like speedy trial rights? Anything?

I would strongly recommend that your retain a Georgia criminal lawyer. It would be difficult to answer your questions without reviewing the court documentation related to your case for specifics. There are certainly statutes of limitations which dictate how long a prosecutor can let a potential charge hang out there without moving forward or dropping it. Best of luck.****The above is for informational purposes only and does not create an attorney-client relationship.******
