We live in Florida and in the wake of the COVID-19 i have to cancel my wedding. The event venue is telling my wife and I that they won't give us our money back, and we must pick another date. Can they do that? We are so overwhelmed
I agree with my colleagues and their thoughtful responses. I had a similar situation in Tampa where the location was underconstruction or being remodeled and would not be completed on-time for their wedding. They picked another date and the location graciously offered to pay for new invitations and cover some other items. HOWEVER, your contract controls! If by law, with all of the closings and restrictions on restaurants and the number of people that can gatherings and you can't have gatherings over "X" number of people right now if they are willing to reschedule the wedding, take the easy road and work with them to reschedule. Or is this a shotgun wedding for "some reason" (no disrespect intended)? If it is, then go to the Clerk of Court and file for your marriage license. Have the Clerk or a Notary Public who is a friend of yours do a low key ceremony at a nice location on the beach or wherever you like. I've performed a dozen weddings as a Notary Public in my backyard, on a pier to at a huge classy location here in town with 250 people in attendance (which you shouldn't and couldn't do right now). Then have your formal wedding celebration/party at the location when it doesn't put hundreds of people at risk. Again, your contract controls. If you don't like my advice, seek the consult of a good attorney in Miami Dade to review your contract and see if there is a provision to cancel the contract and receive a refund. "Congratulations", "Mazel Tov", and "Felicitaciones" on your wedding! I wish you a long and happy healthy life together.
Hello, I agree with my colleague that the cancellation provision in the contract governs. I believe the virus would be considered something akin to an "act of God" if you see that clause in your contract. I believe your best bet is to pick another date. Right now, courthouses are closed to the public. You can hold a wedding with under 10 people in most places right now if you already have your license, and move the "party" to whatever later date is available at the venue. It sounds like you will have a story for your grandchildren. Good luck.

Unless your contract has a provision allowing for cancellation, the company is within its rights to hold you to the contract.
