Im an international student and currently under h1b visa process. Due to covid-19 company fired all the staff. I’m still having my status as student since I am still doing a master but I have applied to the h1b with the 1st master degree I did. I have already done opt and do not have option to do another opt. There is an option to keep with the company u fee unpaid leave.
Should the H1B be counted in the cap the employer may elect to file a H1B petition.
Best to seek to remain in student status until things get back to normal or else depart and wait for H-1B outside the US.
Of course, also have the option to apply for change of status to B-2.
Either remain in status as student or wait outside the US for H1B or file for change to visitor B may be the only options. For your particular situation you should contact an immigration attorney directly for options.
