I am a Baltimore, MD. based Marble & Tile Co. In Jan. of 2007 we called by a contractor that had been referred to us through a mutual aquaintance. He told us he had a 3500sq.ft tile job in the Fort Lauderdale International Airport. We agreed to travel to Florida to complete the job for $450.00 a day per man plus expences(gas, food, lodging). The total Bill was $31,800. with a balance of $18,100. Still Owed. I filed a Construction Lien and it has been recorded in Broward County, FL. and now I would like to file a civil suit against them so a judge can place a judgement against them. I've ordered the legal documents from the courthouse and would like to know what papers to file and in what order.

Contractor Lawsuit

Hi,

We paid a contractor 25K to do some work on our house. It's been 10 months and still the work is incomplete. The contractor took the money and used it for other purposes and refuses to show up. Is there a way we can get our money back? Since he used the money for other purposes and we paid in full can this be considered fraud?

Construction Lien

I had a lien filed against my home by a proffesional con man. I in turn filed a Contest of Lien that specifically stated the lienor had 60 days to sue. His attorney filed a suit on the 62 day and has now caused me a great financial burden because I cannot close a loan. I do not want to sue the lienor because he is a pro and will just file for bankruptcy. Can I sue the attorney that filed the suit ?

Mechanics Lien and Forclosure

If a property is forclosed upon by the mortgage company, does the mechanics lien still get paid during that process or is it wiped out?

I am required to submit an answer to a summons I received. However, upon reviewing the summons I realized that 1 entire page is missing. The missing page contains most of the general allegation. What am I required to do if I don't have all of the allegations against me?

getting refund from contractor

we gave a 5K deposit to a contractor to rebuild our deck. When he filed for the permit, the overall price was higher than the quote, and he wasn't including trash removal or porta-Johns. We decided not to do it. Contractor said he would refund the deposit but has been blowing us off. The contract doesn't have any cancellation clause. What would be the next step?

Town Homes foundation issue

the HOA of my town home that I own sued the builders because there are foundation issues with the homes. They won that was two years ago and they have still not fixed the problem. What can I and the other home owners do about this

I am a contractor who completed a interior painting job. I have only been pd $2500 and she still owes me $2500. When she returned from out of town she called and stated she was not paying me. Her daughter in law walked thru the whole house with me to do there list of touch ups. when they called me they told me if I called them they would charge me with herasment. I when down & put a mechanic lean on her house it has been over two week & I have not heard anything I don't know what to do I have been in bus for 14yrs & have never had anyone not pay when jobs was completed

Pool resurfacing faulty

Pool resurfaced 3 yrs ago and it was not bonded correctly and now it's cracking. Pool company wants $1,000.00 to fix. Company admits it's their fault but says I cannot submit a claim against their insurance company because it's workmanship. Paid $3,440 origninally and there was a 2 yr workmanship warranty, which ended 1 yr ago. What rights do we have in having the job done properly without having to pay for it?

Collection Help

I have an Arizona Contractors License and I act as an estimator for a CA. Paving Co. I bill them once a month for what I sold at the rate of 7% as agreed. I pay my own expences fuel, phone, auto, insurance. We had one project that I in advance to the Contract agreed to cut my commission in half to get the project, I had no problem with that.

Unrelated to that project, I was awarded another project with a HOA for nearly $ 500,000.00 and we were $ 2,500.00 higher than the other bidder who is also reputable and capable. Before we started the project but after the contracts were signed the Co. gave me a $ 10,000.00 commission draw with a sign note of advance, the balance to be paid the following billing. The greedy and wealthy capital partner decided that was to much commission to pay for that amount of work and they would decide after the completion of the project how much or any commission I would get. I than pre-limed the project.

After some heated arguements over this approx. $ 23,000.00 commission balance I moved on to a different Co.

Unfortunatly the Co. I went to does a lot of business with Co.#1. After they got my pre-lime they told co. to get rid of me or lose their business. I'm now unemployed.

non-payment for contract work

I am a licensed general contractor. I did approximately $20,000 worth of work, labor and materials, for a customer two years ago. We did not get a signed contract; she withheld the final payment of approximately $5,000. She requested all of the work I performed, but refused to pay me the remaining amount due. What are my rights and how might I get my money?

Mechanics lien

I had a mechanics lien filed against my property for some concrete work we had done. The contractor who did the work did not charge us anything nor have us sign any kind of contract for the work(contractor was an associate of a family member). Apparently the concrete supplier was never paid and has filed a lien. Do they have a case against me even though I never signed a contract for the work? What should I do?

Roofing Contractor Problem

I recently had my roof re-shingled. The day the job was performed something happened to my electrical system in my bathroom and garage. When we left for work in the morning everything worked, when we came home we had no lights in the bathroom or garage. I contacted the roofer and he brought a friend electrician over to troubleshoot. He came to the conclusion that a wire in the ceiling had been pierced by a nail. The roofer stated he is not responsible for repairs because a wire should not be close enough to the roof for a nail to puncture it. We did not find the wire or nail as that would have required pulling up all the new shingles and roof. We decided that re-wiring the bathroom and garage would be easier. Is the contractor responsible for this cost, since his employees caused the problem? Will his insurance cover something like this? Isn't this the reason contractors have insurance? Please let me know. I don't feel I should be responsible for something they did. The contractor feel he is not responsible.

Is retainage addressed in the Colorado lien law?

Unlicenced handyman

We hired a handyman to paint and carpet an apartment. We did not agree with the charges of $7,000.00. He is unwilling to negotiate a lower price and has taken the matter to small claims court.

There was not a written contract or a written estimate. Is there a civil code that i could show to the court that states that unlicenced handyman cannot perform services without letting me know what it will cost in advance?

Being Sued by a Inground Pool Contractor

We are counter-suing our pool contractor because he walked off

the job. EBT's are set but his attorney and the contractor want to come onto my property to inspect the pool. I DO NOT want the contractor back on my property.

I will allow his attorney to come.

Do have have to allow the contractor to come? What are my rights?
