I just filed for divorce 3 weeks ago because my husband was caught having an affair. He will not move out, however he keeps seeing the other woman. Is that martial misconduct?

Once you file for divorce it may or may not be marital misconduct. Its definitely not the wisest course of action on his part.
You can ask for an order of exclusive possession. Depending on other facts I don't have it might be granted.
