It is almost certain that the state legislature will pass a law or regulation to provide rental relief to tenants who vacate or are unable to pay rent due to the coronavirus Covid-19. However to date, no such measures have been passed. At present, you may be liable for rents due through the termination date of the lease as it is unlikely that the landlord will be able to rerent your apartment due to the current crisis.

If the landlord using its best efforts in the age of fear of Covid-19 does not rent the apartment again to a new rent paying tenant before the lease ends, then the landlord may have a legal claim for the last three months of the lease. The landlord cannot sue for damages for breach of lease until the apartment is rented again. The landlord has the burden to prove that it actively promoted the rental of the apartment and could not do so in order to have a lawsuit.
