I was hit by a truck while riding my bicycle and a truck hit me 7/28/2018. Causing 22 broken bones and brain injury i was in a coma for 10 days. Is there a limit that i can sue the person for. I was a model and actor this accident has hindered me where i can not work. This accident changed my life and caused me to have to move to MA to live with my mother where she has been taking care of me. The person who hit me not only caused me physical harship but also financial and emotional harship where as i cant work. I have issues on my entire left side and i am no longer able to drive. Can you let me know what my options are and what steps would need to be taken. I know i need a good lawyer but i want to know what can be done to get compensated for all the damages that this person caused me and how much can i go after her for.
Seems you already know what to do - contact an attorney to review the accident facts and determine where liability for the accident rest. there may have been some governmental liability but that needed to be addressed some time ago - to late on that one - so stop delaying and do what you already know needs to be done.
This is horrible. But no legitimate attorney can provide you with a value based on this post.
Hopefully the other driver has a lot of insurance, and/or you had high underinsured bodily injury limits of your own.
Reach out to California counsel to help you with this matter. I would not recommend Mass counsel.

The attorneys in this forum will always try to give you the best information possible given the facts that are presented. However, probably 99% of the time, the main theme you will see in any answer is to obtain whatever medical treatment you need for your injuries and then to consult with an attorney, as there is no possible way that any attorney in this forum, based on the limited amount of facts that can be given, can address the issues in full. This is not because attorneys are just trying to get your business but because we know that insurance companies don’t always treat unrepresented claimants fairly.
I’m not saying that all insurance companies are going to try to cheat you by any means, however. I handled lawsuits as an insurance adjuster for thirty-three (33) years for three (3) of the larger insurance companies in the U.S. Those companies always attempted the best they could to be fair and came up with a fair and reasonable settlement range for injury cases most of the time.
However, what you have to understand is that even the most reasonable insurance carriers are going to offer you the lower end of what they consider a reasonable settlement range and try to get you to take it. All insurance companies are in the business of making money and saving on costs and are not in the business of spending money like a drunken sailor. The less than reasonable insurance companies will not be as kind as some of the larger companies out there. Don’t try to handle your case on your own. Stop trying to deal with the insurance company yourself. That's like a two-year-old stepping into the octagon to face an MMA champion.
Your best bet to obtain the maximum injury settlement amount in this case is to consult immediately with a personal injury attorney in your area to obtain a more specific answer and get all of your legal options before deciding what to do and then also complete all medical treatment necessary for any injuries you received. The attorney will also investigate any liability issue and check for all available coverages to ensure you have the maximum amount of coverages available to you. You may have some coverages on your own auto policy as well that can assist you. You can use the "Find a Lawyer" link at the top of this page for the names of attorneys in your area. Most offer a free consultation and work on a contingency fee basis, so you won’t have to pay anything up front.
Please do not message me for further advice or call my former law firm if you have any further questions. If you are in need of an attorney to assist you, please search for another attorney in the jurisdiction involved in your case, as I am now retired, and my former law firm is no longer handling these types of cases. I am active on AVVO and answer questions only as a public service at this point.
IMPORTANT: No attorney-client relationship is formed through interaction with this attorney on this public forum. The contents of any comment or response should be considered general conversational discourse on the topic identified and NOT specific legal advice or analysis that might apply to your situation. If you rely upon any part of the content of this response in making any decision or pursuing any course of action, you do so at your own risk and without recourse against this attorney or law firm.
Good luck!
It seems like your case could be well worth into seven figures. You have two years from the date of the accident to sue. Do not delay otherwise you won't be able to get any compensation. Toy doubt need to limit yourself to the insurance policy. Your lawyer should conduct an asset search of the driver and his employer and push for the maximum recovery. You need an aggressive lawyer who actually tries cases. Those of us that do, offer free consultations. You should take advantage of that.
I wish you a speedy recovery.
Consult with one of us as soon as possible. Many of us are available now for a free consultation.
A lot of money, potentially, depending on whose fault it was. Do you have the police report? I need more facts to evaluate the case.
At this point in time, and in the future, do not communicate with the opposing party's automobile insurance carrier. The opposing party's automobile insurance carrier does not have your best interest(s) at mind and at heart. Yes, you do need to hire a licensed California Personal Injury Attorney to represent you and help you out on an immediate basis (assuming that you were zero percent at fault in this automobile accident, assuming that the truck driver was an insured motorist, assuming that the truck driver had active automobile insurance on the truck that he or she was driving that was involved in the motor vehicle accident, etc.).
Assuming that the motor vehicle accident occurred in the State of California, in which city and county did the motor vehicle accident occur?
On what date did the motor vehicle accident occur?
Was there a police report made/filed?
How did the motor vehicle accident occur?
To answer your question, in order to answer your question(s), there are a lot of questions that would need to be answered, a lot of factors to be considered, etc. There is no straight forward, straight line answer at this stage. It is going to take a lot of fact finding, fact investigating, etc.
You need to immediately hire an experienced personal injury attorney to represent you. If a lawsuit is not file before 7/28/20, your rights will be forever lost. Call attorneys to see who can start on your matter immediately. Do not delay.
Hi. I usually don't deal with posts so far away but yours caught my attention. I used to be known as "the bicycling barrister" by some but quit riding largely due to the associated dangers.
The upward limit of your claim may be the financial responsibility of the persons associated with the truck, e.g., driver, owner, principal, etc. and the limits of any insurance which you have. Our State has minimum liability limits for collisions that smack of a feudalistic disregard of the citizenry. Even typically ample limits may not be adequate for you. There may not be adequate assets beyond insurance to compensate you.
Of paramount concern is your role in the collision. To the extent the evidence shows you to be at fault your claim is to be discounted. Anyway, I am so sorry that you have suffered, and will suffer, so. Your physical and emotional injuries, your loss of enjoyment of life, your loss of earning capacity, and your lost earnings are all compensable to the extent caused by negligence of the person(s) associated with the truck.
If the government had any liability, you lost any such claim 180 days after the collision.
You need to file suit by 7/28/2020 (or such later date that Courts may reopen after the covid-19 Court closures) to avoid your claim being barred by the statute of limitations.`
A lawyer will take it from here.
You need to speak with an attorney to discuss the entire situation including a review of all of your medical and billing records, the impact on your life, and the financial position of the defendant will of course be important as well. Most of us still offer phone consultations even with this coronavirus thing going on.
